Subject: Visitor Visa before Genuiness of Marriage Appeal
  I am getting conflicting answers to my possible request for a Visitor Visa for my husband. The question of the genuiness of our marriage is in appeal and the previous cases I read say Visitor Visas are denied when you are in the appeal process. I am Canadian and have been to his country, but he cannot come to Canada without a Visa. We are just trying to avoid an unecessary appeal if he doesn´t like it here...or is this being too logical???

too logical. CIC does not want hubby showing up, losing the appeal and then having to spend months and endless money to get him out of the country. It is simply easier to say no to him coming in the first place.

We have tons of reasons for him not to defect and if he doesn´t like it here I am ready to leave and go there, but will anyone at CIC understand this rationale? Throughout this whole process we seem to be anomolies as the stereotypes from the past are against us. An immigration lawyer told me the onus will be on him to prove and prove and prove why he will return to his country. Oh well, it´s worth a try.

both you and your lawyer are right. the worst they can say is no. don´t buy a plane ticket until you know.

Today I read that medicals etc. are required for the visitor visa and all of these requirements can cost up to $1,000. Does anyone know if I need all of these before the visa is approved since I could use the money elsewhere if there is a strong chance of denial.

Slow down Nancy

You already have a refusal letter from your spousal sponsorship & I assume you have already submitted the appeal. The IAD in Vancouver is real slow but getting better! You need to expect four months to get the record and another one or two to get an ADR date in Toronto. Get the CAIP´s now and see what the officer wrote about the interview.

What has changed prior to getting a negative decision on your spousal sponsorship interview? NOTHING! You both wanted to live in Canada and make your future happiness here.

Nancy you did not focus on proving your relationship sufficently and the officer probably found a couple of answers unusual from your husband side. Find the minor problem and fix that!

Get MORE information to prove your relationship which should be easily obtained. Stop using calling cards!!! Video calling by Messenger and Skype is great because you can see each other but get pictures of the two of you chatting in different clothes.

Modern communicating does not prove how often and for how long each call is placed.

Get on a plane yourself and go see him instead. Take photos with his friends because just the two of you in a photo leads to this question; "All of these photos just have two people in them"! WHO TOOK THE PHOTOS?

Know every ones name in each photo, where his siblings live and if they are married, review the forms again and again. Hire someone who will not just say "have your husband apply for a Canadian Visitor Visa". That is what you want to here but you know the odds are the same as you winning today´s 6/49 lottery. Buy a ticket instead and if you win pick a tropical Island instead of Canada.

I understand the two of you miss each other but this relationship grew and grew and from the way you write your relationship sounds very real.

I do many spousal appeals and I never recommend someone who has just been refused a PR Visa to apply for a temporary visa just so they can play house.

If your in a real marriage (prove it) and live Happily Ever After!
