Subject: Canadian Citizen Sponsoring US Overstay Alien
  My friend who is a Canadian Citizen is planning on coming over to the US to marry me. We thereafter decide on settling in Canada. I had entered the US on a Tourist Visa 10 years ago and overstayed. I am currently out of status in the US.

If she were to marry me in the US, can she go back to Canada and apply from there ?

Would there be any complications with the Canadian Immigration authorities concerning my overstay in the US and would there be any personal interviews prior to approval of my application here in the US ?

Would the case be turned over to a Canadian Embassy here in the US ?

there are many successful stories of overstayed people from the US...

Many concerns were posted before regarding the FBI clearance certificate that you have to submit..but I think the FBI do not deal with the immigration issues...

On the application, you have to declare your status in the US..but I don´t think Canadians care about the overstay if your records are clean.


If you´ve hiding for 10 years...I hope you will manage to continue your hide until you escape!!

You will have to comply with regulation 11 which dictates where you are allowed to submit your application.

Can anyone explain in detail what is Regulation 11 and how does one comply with it. If anyone could list a url that explains in more depth that would be much appreciated.

http://laws.justice.gc.ca/en/showdoc/cr/SOR-2002-227/bo-ga:l_2-gb:l_1//en#anchorbo-ga:l_2-gb:l_1 because you were not legally admitted into the USA for one year even though you reside there you have to apply in your country of nationality.

The first time (1999) I was admitted for 6 months and then I extended for another 6 months by applying to INS. I was granted that extension. That made it 1 year. Before the expiry of the extension I left and returned 4 months later and that is when I overstayed.

Would this count as 1 year admission ? and can I apply from here in the US ? I have a Social Security # and have been filing taxes over all these years.

Roy, Thanks you for all your answers.

Appreciate if you or anyone can comment on my previous message please. Would there be any way out to have the interview in the US rather that my home country which is India ?

I am saying this because if I were to have the interview in India, I will have to leave the US which will not permit me back incase the Canada interview fails. That leaves me neither in the US nor Canada.
