My application was just returned from Buffalo for the lack of proof of status in the US. However, I do not have because I entered here with a 6-month tourist visa and I overstayed. My lawyer sent the application again along with a letter requesting then to transfer my application to Brazil, my home country. However, what else can I do to check if they transfered or not application besides waiting? Can I e-mail them without telling my lawyer? Will he find out? Can it affect my application if I e-mail them? Also, does anyone know their e-mail address in Buffalo?

This posting seems unbelievable I read it three times. So Buffalo returned the whole application with an explanation as to why. That would be Regulation 11 and where your entitled to submit your application!!!
Your Lawyer knowing Regulation 11 in the first place sent it to Buffalo and then sent it all back to Buffalo expecting them to pay postage to Brazil?
Here is the picture I´m having trouble accepting.
Now you sought out and researched which authorized representative was best, got references from him/her, paid that authorized representative, worked in conjunction with that authorized representative, informed that authorized representative of your whole address history, clearly explained that you only entered for six months and not a year, yet your file was sent to Buffalo in violation of regulation 11!!!!
Who is to blame?
Look in the mirror.
Main reason I can not believe this story. Any Lawyer can do Immigration cases with no experience but can you be so ill informed to hire someone with no experience?
If this Lawyer is in Ontario the LSUC does not discipline for Professional Negligence which is a matter for the courts. Let the Buyer Beware.

Well, it was not my lawyer´s decision to send it to Buffalo. It was Sydney´s mistake because my application was sent to Sydney fo assessment and even though they knew I was out of status they still requested me to send it to Buffalo since I live in the US. It would have been a violation if my lawyer had sent my application to Brazil since they do not have my file number in Brazil.
