You sound a little aggressive because for two whole days nobody responded to your question. People answer here because they want to. There is nothing in your posting as to why you need to research this information. Although I have my opinion.

What gets me is that you found IRPA 28 (2) (a) (V) and you read it and did not understand it. Why?

28. (1) A permanent resident must comply with a residency obligation with respect to every five-year period.
2) The following provisions govern the residency obligation under subsection (1):

(a) a permanent resident complies with the residency obligation with respect to a five-year period if, on each of a total of at least 730 days in that five-year period, they are
(v) referred to in regulations providing for other means of compliance;

So did you google Immigration Regulations and look up Residency? Did you search this forum regarding Residency? Nope you demand but at least you demanded without using bold type. This question has been asked and asked and asked and all for the same reason.

Roy,

You are rude and aggressive for no reason. Although I am not going to make excuses to you I wish to clarify for (other) participants of discussion that when I referred to two days, I am talking about my personal time of search though all possible sources, and only after I have failed I posted my message. Of course I am not waiting for you to apologize Roy since it seems you are not this kind of person.

Now to the point.

You misunderstood my question.

In paragraphs (i)-(iv) the Act lists 4 different means of compliance. The regulations you refer to (and of course I do have it) clarify these 4 points.

At the same time, the paragraph 28(a)(2)(v) says about something IN ADDITION to these 4 options. And refers to some OTHER regulations.

So my question was and remains whether anybody saw it.

When one posts a question others are going to ask (why) since you never gave any hint as to why your researching residency. I asked and got no response.

Maybe just maybe you don´t want the readers to know. Lets see.

Your doing research on residency for your high school project or.....

Did Nban become a Permanent Resident and decided to leave his family here so they can get the benefit of Canada while he is living abroad?

Has Nban been living abroad ever since obtaining Permanent Residency Status and now needs to renew his Permanent Residency Card?

Is Nban in another country and can not consult in person with an authorized representative regarding his residency status?

Me rude and aggressive? Nban you can interpret my polite response as you may like but compassion is common sense and the question is, do you deserve compassion?

You used Capitals and you can try to use smoke and mirrors to explain away the two day issue but your up the creek and your boat has a huge hole in it. CAPITALS is yelling!

The regulations further define that Act so for those others concerned about residency requirements here is an explanation.

Regulation 61 (1) & (2) covers further explanation of IRPA 28 (2) (a) (iii) & (iv)REGARDING WHAT IS A CANADIAN BUSINESS!

Regulation 61 (3) covers further explanation of IRPA 28 (2) (a) (iii) & (iv) REGARDING EMPLOYMENT OUTSIDE OF CANADA!

Regulation 61 (4)covers further explanation of IRPA 28 (2) (a) (iii) & (iv)REGARDING THE DEFINITION OF ACCOMPANYING OUTSIDE OF CANADA MEANS!

Regulation 61 (5)covers further explanation of IRPA 28 (2) (a) (iv) REFERS TO COMPLIANCE OF AN ACCOMPANYING PR THAT COMPLIANCE IS VALID IF THE PERSON THEY ARE ACCOMPANYING COMPLIES WITH RESIDENCY OBLIGATIONS.

Regulation 61 (6) covers further explanation of IRPA 28 (2) (a) (II) & (iv) REGARDING THE DEFINITION OF A CHILD MENTIONED IN IRPA 28

So Nban do you really think that there is some hidden issues covering residency in the regulations located somewhere else in the regulations that are not listed in the index.

NOPE, so start bailing your boat it is taking on water fast!!!!

Nban it is always best to tell the truth, that way people can show you compassion and when you get a polite intelligent response don´t blame others for your situation.

Now like I said Compassion is common sense so if you need to plug that hole in your boat so you do not sink read

IRPA 28 (2) (c) a determination by an officer that humanitarian and compassionate considerations relating to a permanent resident, taking into account the best interests of a child directly affected by the determination, justify the retention of permanent resident status overcomes any breach of the residency obligation prior to the determination.

So now read Inland Processing Manual IP5.
