Subject: PR Card and PR Status
  Hi, I was first issued my PR Card in Dec 2004, at the time I had already finnished my 1st year at a University in another country. Now my PR card expires in Dec 2009 and during this period I have only visited Canada once (for about 2 month), the reason I stayed so long out of Canada was because of my studies and the fact that I had to work (as part of contract agreement) for a year at the company that paid for my tuition.

Now, as i gather from other posts your PR Card and PR Status is not necessarily the same. You lose your PR Status if you do not spend two years in the 5 year window, i.e. I entered in 2004 so in 2008 Jan I lost my status. My PR card is , however, valid till Dec 2009 which allowed me to travel to Canada earlier this year (though the airport official were not that happy).

Now my questions:

[a] If I enter Canada for good before the expiry date of my PR Card (Dec 09), what happens to me after this period? Will I become illegal in the country? (lets assume that I will not be travelling out of Canada)

[b] Is it possible to obtain a PR Card if I stay in Canada from Dec 09-Dec 2011? Or will this be rejected as I did not remain in Canada for more than two year during the initial window?

Sorry for the long post, But I would be grateful if someone could help me.

You may enter Canada given that your PR card is still valid but it really depends on the immigration officer you get. The factor that he or she will consider is that your status will in December and they will surely question you about your plans after that date. You will not be able to reapply for a new PR card and your status in Canada will laps at that time. You will be a "Stateless Person" and yes, illegal in the country. You are best to consult an immigration consultant or lawyer for your issue. I am a student-at-consultancy and am not familar with possible outcomes.

Well I asked my lawyer and this was his reply:

"The best bet if he wishes to retain his status is to return to Canada before the exipiry of his PR card, then he can renew his status for five years but only after he has remained in Canada for 2 years"

but he fails to answer what happens to me after the Dec 09, I think I will call him up next week and sort things out.

This is an interesting issue.

Ideally, by theory you´ll lose your PR status after Dec. BUT, in reality it is very hard to lose. As Immigration Canada doesn´t give a very hard look on this issue. People When you´ll be applying for the new PR card you have to tell about your absense in the last 5 years. It is the only way they can determine whether you lost your PR ship or not. They don´t ask any documentation or passport entry/exit seal to verify. It is all upto you. I´m not suggesting you to lie anyway, but it is the was how many thousands PR ca successfully retain their status years after years.

If you can cross the airport immigration successfully then the major worry is gone. If the img. officer is very sneaky then he/she might dig more about your absense and start calculating the das you were outside of Canada by giving hard look at the entry/exit date stamping.

They CAN ask for copies of ALL pages in ALL passports you held if you are suspected. Then it is: The End! But don´t worry, you can always start yet another application for PR. And keep living where you live and working. Enjoy life. Canada is not for you in all likelihood. Good luck. By the way, there are no more jobs around here and more jobs are being eliminated, but don´t tell others... it is a lil secret.

Well I spoke to my lawyer the other day and according to him, a PR card is a tool that enables you to enter the country, if it expires you wont be able to enter the canada. He also told me that if I enter I will not be an illegal immigrant after the card expires, he didnt tell me what this state is called but he kept on refering to the term "landed immigrant". And finally he said after entering (before expiry period) I would have to wait atleast 2yrs before applying for a PR card again (as they look at the amount of time you spend in canada during the previous 5 years), this would mean that I would not be able to go overseas during this period.

Well I hope he was right, any inputs ?

He is spot on! I know several Landed Folks who simply did not renew their PR cards for whatever reasons and have been gainfully employed in long-term jobs; These folks have no need to leave Canada since they have established themselves in Canada and do not have serious ties in their countries of origin. You won´t suddenly turn into illegal just because you don´t have a currently-valid PR card. However, when you need the card, you can provide them about your continuous stay in Canada and ask for it or the citizenship. The trick is, you need to be ready to sit tight in Canada, find some job and continue to live. It is the folks who keep flip-flopping about where to live that seem to have troubles.

And this would be on one of the people in fact worse.. 2 months total in 4 years

PR Card renewal (in reply to: PR Card and PR Status)
I submitted for the renewal of my PR card. Would like to know the status update. I will need my renewed card by Dec. 15th due travel to South Korea and my return to canada will be Jan. 15th, 2014. My old card will be expired at that time.
