Subject: Need help very badly
I really really need some help and advice, my boyfriend who is from new zealand originally came here as a 6 month visitor (no visa) and while here we applied for a work permit which was approved allowing him to stay and work here another 6 months. Well that expired July 22 and I didn´t research or prepare enough I´m kind of stuck. I was working on a common law sponsor visa, though I´m confused. Some sources say it´ll take 6 months to process, others say 1 month. Also I´m not sure if he has implied status while we wait for it to process. And if he doesn´t, can we simply go to the border and extend his visitor stay for another 6 months?

There is no implied status while your application is being processed. You should apply for a new 6 month visitor permit within 30 days of expiry - this allows you to stay until it is approved or rejected even if it takes longer than your previous visitor was valid until. I don´t know much about the work permit side of things. They don´t really like it when you cross the border just for a new visa - I did it once and they made me give a date when I was going back to the UK - so I did, and then came back for another six months. So in that period of my life I was in Canada for a total of 18 months all with proper visitor´s visas. After that I stayed away for 18 months to let things cool off in case they were pissed at me.

Expired when? July 22 2009 or 08? Common law is tough - you get put through the wringer more - marriage would be simpler if you feel you want to anyway.

Be very careful with lawyers they may suck you dry and you can do this yourself with so much support on the net from sites like this and:

If you look at this site and put in the appropriate countries it will give you an idea how long other people took to get approved.

Where abouts are you? I´m a brit on Vancouver Island and got married to my canadian GF here on Jan 1st and applied before end of January through London.

Good luck

Clarify (in reply to: Need help very badly)
That should read - 30 days before the visitor visa expires.
