Subject: Sponsorship of a dependent child
  My ex husband sponsor our two children for PR. They´re visa´s are in and passports are stamped and have been returned. Does he (the sponsor) have to take the kids personal to the border and sign for their landing or can i being their mother do it as well. He´s giving me a hard time and is now refusing to sign for them. He´s blackmaling me saying that if i don´t go to friend of the court and make his rearrages to a zero balance he won´t sign for their PR card. THat i´d have to do their app´s all over again myself.

you post is very confusing.

are the children currently in Canada? where are YOU in all of this? who has custody? have the children landed or is the passport stamped waiting for landing.

what is the statement about blackmail and friend of the court - all that makes no sense at all.

The children are with me, in Canada on a temporary Vistor Visa. I have custody and permission from the court to take them from USA to Canada. They have not done their landing yet because their passports are in possesion of their father. He calls me up this afternoon, demanding that i go with him to the friend of the court and make his rearrages to zero balance (which he owes currently $3700 USD), and if i don´t he will not take the girls to the border to complete thier landing. He says supposedly since he is the sponsor he has to sign for them. He is also saying that immigration is charging him another $600 or so. For what, i don´t know. Passports were just received in the mail with their visa stamp for Residency. We just need to do the landing. I don´t want to make his child support balance to zero, it´s not fair to me. But if i don´t then i´d have to restart the kids paperwork all over again. After he´s already paid everything. I´m here in Canada on a temporary work permit (2 years) valid until sep.2010. I´ve just applied for FSW with AEO back in March 2009. My application was accepted and is under review. I´d have to refile my application to include them and have to pay more money. Yes I can do it but why do i have to go through all this just because this A@!Hole want´s to play games.

let me try this again.

where is ex-husband living - in Canada? if so, how do you intend to collect the $3,700 you say he owes you in support payments? Canada will not collect it for you.

what will you do if your FSW application is denied but he has sponsored the 2 children.

he may be an A-hole but you also may be totally unreasonable. How much has he spent to sponsor your 2 children - medicals, fees etc. $3,700? or there abouts? Close? who asked him to sponsor the kids - you? did you give him any money to help?

Sorry that this is so confusing. He lives currently in Windsor but is collecting Unemployment benefits from Michigan. He is a US citizen as well as a Canadian Resident.

I never asked him to sponsor them in the first place. It was him who wanted them to come and live with him. Which was started about 4 years ago. Yes it made it a little convienient for me later, how is that making me unreasonable? It is his child support that he is past due on.

I supported his stupid butt for the last five years of our marriage, he didn´t want to work not even part time, didn´t want to study, didn´t want to do anything. Just spent my hard earned money. I had to work 56-60 hours a week to support all five of us, for five years The way i see it. HE owes me.

At our divorce, I was trying to be nice and gave him a break. I accepted a smaller amount per week of child support. I could have gotten a whole lot more, but no obviously that was a stupid thing to do. He only paid 150 a week for three children. He was suppose to help me out with the medical insurance and extracuricular activities and never did. My eldest was four when he left and now she´s fifteen. I really don´t think i´m being unreasonable. If he doesn´t pay up, eventually a warrent for his arrest will go out on the US side. IF he doesn´t pay up then all of his Tax return if he gets any will all go to me.

I am sure you have lots of reasons to be angry and divorced but that is not what you asked about.

So... he sponsored the kids, as far as you know, he has to sign for them. I guess first thing you do is confirm the signing question. Quite frankly, I don´t know so I can´t comment on that part.

At this point he has the passports of the children. Will the police help you get them - if you have legal custody... maybe but that does not answer the above questions.

Still puzzled how he could sponsor them if you have custody. Did you give permission? How can he collect unemployment in the US and be living in Canada. sure does not work the other way around. But that is between him and the US government.

I doubt that you are going to get any help from Canadian authorities on this one so you have to decide what is worth more to you... $3,700, changing your application and paying the additional fees, or holding your ex accountable (which from my experience is a bit of a crap shoot)

To spnsor my disabled, dependent son to canada (in reply to: Sponsorship of a dependent child)
I am a permanent resident in calgary, AB for more than tree years now. Instead of sending my support to my dependent and disabled son to my country, who is under the care of my wife, who is also my dependent, is there a way we could be reunited in canada through sponsorship? My wife is a PR holder but preferred to stay in the Philippines to care for my son. Both of them are my dependents.
