Subject: Application rejected for Federal Skilled
  Hi All,

please i want to know where to make an appeal for my application that was rejected under the new Federal Skilled worker. According to the letter the Service Delivery Specialist said that she was not satisfied that i performed a substantial number of duties of the occupation as set out in the occupational description of the NOC.

i want to determine if the duties was the first basis or the years of experience because it states that one year of the last 10 years and not duties performed.

i will want your advices.

there is no appeal process for FSW applications. when you apply, it is critical that you review the detailed information in the NOC codes in terms of duties and either find the code that best suites your job experience. You also need to prove that you performed those duties for at least 2 years in the last 10.

It is the responsibility of the applicant to satisfy CIC that they qualify under these 2 criteria.

Sometimes just filling the application is not enough. You have to write an ORGANIZED cover letter explaining your work experience, education ..etc and show how you got the calimed points under each section. Such a letter will be greatly helpful to the reviewer in order to understand how you claimed your scores. Those reviewers go over tens of applications aday and may not have time to review things in details...and therefore may miss things and reject the applications. It is also advised that you support whatever you claim with documentation. Moreover, highlight any areas of strenght in your application even if it is not required such as academic or prefessional awards, outstanding accomplishments to the community, letters of recommendation from employers ....etc to show that you are a highly qualified candidate. All these tips may minimize the rejection.


Some immigration officers would not be convinced with the points you claim for each section.Therefore, supporting your application with a cover letter explaining your points and showing your experiences and capabilities is extremely important.

you need a well articulate legal pro like me to help you out. Now that you are rejected, you need help more than ever. However, it would cost you around 5k US$. I would say you better hire legal help when you proceed next.
