Subject: Help me Immigrate PLEASE!!! Expert Help needed.
  Hi everyone. I have a story to tell and I, before writing this, wrote it and deleted it(it was getting kinda long). I will try to make it as short as possible. Please Help.

I was deported from the US on June 13th 2006 on the grounds that I committed a deportable criminal offense (charged in 2000 when I was 19). I wanted to marry my girlfriend then, now my wife, but the judge told me at my hearing that it would not help me. Anyways, I married my wife on Feb 22nd 2008 on the webcam. Why webcam? Because I wanted to make my case stronger and I cant offered to spend money on travel just yet. I LOVE MY WIFE. Her and I have been together since Nov 1st 2003(can be proven if asked by the immigration). This is not how we wanted to get married, but circumstances. Well anyways, we looked into filing papers to get me back to the US but it seems costly and very time consuming with a less than 50% chance.

So we decided that we would try for Canada. She is a born US citizen. She just finished her Bachelors and is working full time at Meril Lynch. I only completed high school and have some years of work experience in different fields. Now what I need help with is how should we apply. She would put me down as a spouse on her case. Should she apply as skilled worker or should she just apply for regular immigration? Which one would be the faster of the two? Should she apply from the US or should she apply from within Canada? Again, which one would be the faster of the two?

I am in Pakistan and I dont want to live another day here. Dont ask me why, I just dont want to. I am psychologically torn into pieces. I am extremely depressed. I dont want to be without my wife. My family is torn apart. My family is on welfare now in the US. My father is permanently disabled and my mother is a house wife. I used to work and support them. I dont have much money to spare now so I have to pick one method of applying for my Immigration with the best and fastest outcome. My relatives have the money and are willing to give me some but I refuse to ask for their help(another long story). If I tell you about my crappy life Im pretty sure it´ll bring tears to your eyes.

I ask for expert advice on this. Please do help. Thank you.

The ONLY way your wife can immigrate to Canada is a Skilled Worker applicant. She will have to qualify under a specific list of job profiles called NOC codes. She can check the CIC website to determine if and where she might fit in. Obviously, you want to be listed as her spouse. If she has sufficent points, and is in a skill category that Canada is accepting at the moment, both of you are going to have to qualify medically and criminally.

You were charged and deported in 2000. Is there a conviction on your record? If so... you have a problem.

You probably have better odds getting back into the US than the 2 of you coming to Canada.

Thanks Sharon for your advice. I was charged in 2000. I was ordered deported in 2004. I appealed the decision and filed a brief. Lost the brief and my lawyer told me some BS. My Immigration lawyer told me to reopen my criminal case and as I was trying to do that I was picked up from home and deported on 13th june 2006.

I do have a conviction on my record, but its been almost 10 years since. Would that help? I read some where about rehabilitating criminal....something, cant remember. I read something about a 10 year rehabilitating period from the conviction for you to be able to apply for Canadian Immigration.

Do you know how long is the process from US for the skilled worker app?

rehabilitation is not automatic. It has to be granted. I stand by my first suggestion.

Hi

we in canada don´t need America deportee, we want law abiding people. we need educated people that will contribute to the development of Canada.you can return to America with your spouse who cares? are do we know the numbers of crimes you´ve committed in America before your deportation. please stay in Pakistan and invite your spouse to come. Moreover, what is the big deal about Canada. you can make a good couple in pakistan.

Thanks Adible. This is just the advice I needed. When I committed those crimes, I was only 19. I drove couple of guys to a place where they stole a car and later they decided to rob that house. I drove them there. I did not know that they will break into that house. No one was home. It was their plan. I just drove them there. A week later after stealing those cars, the other guys got caught and told on me. I was arrested and charged with 3rd degree burglary and conspiring a juvenile. I was 19 and they were 17(minors by law). Everything came down on me because I was an adult 19 and they were minors. Those kids we school drop outs, carried weapons, did and sold drugs, had previous charges and were in gangs, but the court did not care as they were minors. I did what I did because I was pressured into it. I lived in a very bad neighborhood. I was a freakin kid, I didnt know what I was doing. I was a B+ student. I am 28 now. I had never committed a crime before then nor after. Please dont judge me. I am paying for this mistake quite heavily. Everyone that knows of me back in the states speaks very highly of me. I am a respected man back home. I have many friends who love me as I was always there for them to depend on. Every job I worked at, I did my best. I made a name for myself where ever I went. I always helped the poor and the needy. I always opened doors and gave way to others. I dont say things that can hurt others. I have always been courteous to others. I am proud of the man I have become. Please dont judge me. Ive had a very hard life and I have done the best with it. So if you can help me then I am extremely grateful for your kindness. Thank you so much for your help.

Adible, are you completely without sin? Have you NEVER made a mistake? Please... a life without having made serious mistakes or having bad judgement is too much on the safe side--and is it really living? How do we learn if not by our mistakes?

And please, don´t speak for ALL of Canada to say we don´t want American deportees...and if you watch the news a´tall, you´ll see plenty of non-law abiding citizens here already! How do we know one day YOU won´t break the law? Do you have a crystal ball of the future? Hmm?

The "big deal" about Canada is its rich cultural diversity, democratic freedoms and boundless opportunities. I for one, do not want to see a homogeneous society of boring palettes of tan/white skin and lack of sumptuous customs and foods.

Tamour, I wish I had practical advice to offer. Perhaps you might apply as a temporary worker here? I don´t know how it works or whether you´d qualify, but it doesn´t hurt to look into it. And maybe your wife can look into a transfer within her company if there is a Cdn counterpart? Or she might start scouring Canadian job sites for something in her field? Where there is a will, there´s a way. Just have faith and the Universe may deliver! :)

all nice advice writerlychik but none of it will work. He must pass criminal clearances - and he will not pass without a formal pardon.

Sharon, how long should I expect the whole process to take? I mean after I have been cleared or have been pardoned. Thanks.

the pardon process takes about a year. Then you can start your sponsorship application.
