Subject: Application from within Canada
  Hello,
My girlfriend (Canadian) and me (Dutch) have a relationship since 2002.
We flew back and forward from 2002-2004 (6 times a year)
lived together in The Netherlands from april 2004-sept 2006
Flew back and forward 2007-2009 (6 times a year)

My girlfriend got homesick in 2006 and the idea was to start the residence application in sept 2006 but due to personal circumstances (health issues of my parents) we never did.

Now however we would like to start the application but I´m thinking of doing that from within Canada. (We´ve been apart for too long now...)

Does anybody know what the chances are, this application could be succesfull, considering our past together?

We can prove we have a relationship since 2002...Medically I´m ok, No criminal records etc.

I think at one point I can start working if I´m in Canada?
Can I leave Canada during this application?

Hope somebody can help me.I only want to do this application if there is a big chance it will be succesfull...

1- Does your girlfriend qualifies as a sponsor?

2- Your chances of being succesful will depend on filling the proper paper work in a proper way which includes to demostrate that your relationship is genuine.
It is up to you to demostrate that.

3- If for some reason your application is denied, you have no right to appeal it. (In-land applications)

4- During the process you may leave Canada, but they may not let you back in.

Why?
Because as far as paper work goes, you still a turist until your application is approved. Applying for a PR within Canada shows that you have no intentions of leaving the country any time soon and if the officer suspects that your are going to over stay, they will simply refuse your entry and from there, things can go south pretty quick.

You should consider applying from outside of Canada.

1- It is faster
2- If your application is denied, you may appeal the decision.
3- It is safer for you to visit Canada while the application is in process.

As far as H&C application goes, as far as I know, it takes pretty long. I filed my application 2 years ago and found out that it would take another 2 years to finalize. Can you imagine how wasteful of individual´s time that would be? You can´t do job or join school. You can´t do anything during that time. I just can´t fathom what makes CIC staffs take so long to get it done.

-Nothing to do with the price of tea in China here.

We are talking about a Family Member application. I think that an outland application is your best bet.

Sorry to point you out but there is no such category for inland application. Whatever your reason may be, if you want to file from within, you can only file as H&C and give that reason in your application. (Of course there is inland refugee claim but that doesn´t pertinent to this post.) Ever wonder why spouse of pr/citizen got refuse at port of entry?

There is a category called Application for permanent residence in Canada — Spouse or common-law partner

And it is NOT an H&C application.

You are more than welcome to read the facts at the CIC website.

Why a spouse of a PR got refused of entry at the border?
If she/he comes as a visitor and they don´t convince the officer that they will leave Canada at the end of their visit, their entry might be denied. Simple reason is that they are going to violate the conditions of a "turist" of temporary visitor according to the Immigration Act.
If they want to move up here, they will have to apply for the right visa in order to come.

See, the problem is when a "visitor" shows up at the border with the kitchen sink and 8 suit cases and tells the officer that is here "just" visiting his/her spouse for two weeks.
