Subject: misrep and reapplying after waitng period
  Hi All,
Can someone advise me in the following situation,
i sponsored my wife more than 2 years back, and because of a stupid mistake on our part, my wife was banned entry for 2 years beacuae of misrep... i appealed the decision and initially it went to an ADR but it was refused from pakistan Immigration office, even though the immigration board in toronto sent a letter to pakistan for the misrep to be dropped. now we have gone thru for the full appeal and it can take almost another 8-10 months before we get a hearing.

would anyone recommend me to drop the appeal and reapply for my wifes PR?? and if so, do i have to wait the full 2 years and then reapply or can i reapply now, even though my wife is not able to enter until may 2010
so should be stick out the time and wait for the hearing???

I think you should read your question again that you posted here.

When you applied you guys (lied) so the exclusion was for two years instead of one year.

You the sponsor appealed.

You appealed to the IAD Immigration and Refugee Board in Toronto.

Now CBSA from the 10th floor has to believe due to your explanations that you would be successful at a full appeal to concede.

They conceded!!!!!!!!!!!!!!!!!!!!

The DRO Dispute Resolution Officer from the IRB typed up the letter while you were in the room and either you or your counsel signed that letter explaining your explanations why there was no misrepresentation.

The IAD directs that your appeal is successful.

The IAD mail the visa post the letter to inform them THEY MUST continue processing your spouses application because of reasonm 1, 2, 3, etc.

The IAD direct CBSA to return the applicants file to the Visa Post for further processing which they do.

Then you claim the Visa Post says to the IAD we don´t care what you say we are still refusing the application????

Some times when one lies they just do not know when to stop telling lies!

No Visa Post can over rule an IAD decision to continue processing a spousal application.

This type of appeal would never have gone to a Alternate Dispute Resolution ADR it would of gone right straight to a full appeal.

I love the Spousal Appeal Process because too many people are refused because of others who lie or submit bogus applications. Simple little errors or omissions can easily be explained and the loving couple can be reunited. I´m attending at the IAD twice a week and I can state they are fair and they all uphold fundamental justice.

Too many well deserving loving couples are sent to the Spousal Appeal process for little or no reason, your application was..............

Hi,

first i want to clear, i will not blame any visa post or the immigration and refugee board for mistakes i made. i beleieve they have been fair so far in all this process. just the time process is killing me.

my case is unique, i wish i could explain it over on this post but i dont want to confuse anyone...
i just wanted to know if anyone knows if 2 yrs time has to pass in order to reapply or can i just reapply now and send a letter with my application stating the previous mistakes we made, and will they reject because 2 yrs hasnt passed or will they accept and just issue the visa once time has lapsed??
if you have an email address i can contact u roy, i would love to give u an explanation of the whole process i been through and my situation.

hi Roy,
i just wanted to respond to your last line, that " to many well deserving loving couples are sent to the spousal appeal process for little or no reason" my application is genuine and a real Marriage, i am not one of those who will cheat the system.... if u trying to say otherwise... the process isnt easy, having lived and grown up in canada all my life, i understand and respect the system and rights we have been given.
was just looking for some feedback, I love my wife dearly, we are having a tough time being away from each other and so i thought as a responsible and caring husband, i think i have the duty to look for other options and feedback in our application process. Not All Lawyers will give you the best advise. So learning from others and there experiences can help make a better decision.

There are an awful lot of people pretending to be people with legitimate issues on this forum when they are not. I agree that everything can not be explained here especially the detail.

That is why I said you should read your question again it does not make logical sense. I thought I went into the reasons why I made that comment in great detail.

People can be caught in a lie by their interpretation of any particular question. Many have asked for assistance and got ask the question incorrectly and been found to misrepresent (lie).

My remarks were general in nature and why people think it is personal is beyond me.

Far too many are required to appeal their sponsorship for totally illogical reasons. Does that make you feel better?
