Subject: Sponsoring an American Wife
  Hi All:

I am a canadian citizen living and working in canada as an engineer. I plan on marrying my fiancee in 2010 and then sponsoring her for her permenant residency. We also plan on applying for an open work permit so that she can work here while the permenant residency is in progress.

My questions are:
-Will she get an open work permit? How long will it take. Seems to say about a month online
-Will she be able to leave to the US for vacation after applying for PR?
-How long would the inland application for PR take?

On another option.
If i were to go to the US to work (since it might be easier for me to get a TN VISA under NAFTA) can i sponsor her PR Application while working and residing outside of Canada?

Thanks for your help. I really need some input. Im also going to call CIC tomorrow to see what they have to say.

She might be able to apply for a work permit after the approval in principle is done but it won´t take a month. It will take anywhere between 3 to 12 months and that doesn´t include the approval of the application.

-Will she be able to leave to the US for vacation after applying for PR?
She can leave Canada and go to the US, the thing is that she might not me able to re-enter Canada and things can go south pretty quick from there. Why?
Well, she is entering Canada as a visitor which is a temporary status but as she is applying for a PR, the officer may think that she won´t leave Canada at the end of the time authorized and that is against the immigration law under "temporary status" if the officer thinks that she is not going to leave the country, they will reject her admission into Canada.

-How long would the inland application for PR take?
Anywhere from 8 months to 2.5 years.

The problem with inland applications are that if for some reason the application is not approved there is no right to appeal the decision of the officer and she will be removed from Canada.
The other problem is that it takes longer to be processed.

You should think about applying from outside of Canada (in the US) an application from abroad is finalized faster and if for some reason is not approved you have the right to appeal and as long as she can convince the immigration officer at the port of entry that she is ONLY visiting Canada while the application is in process, she can visit Canada back and forth.

Look into "Sponsoring family memebers" at the

www.cic.gc.ca

You as a Canadian, may sponsor your wife while outside of Canada.

Cheers,

Bill

Thanks for the info. This is what i thought.

I think the outside of canada application is the best way to go.

Cheers!
