Subject: where do I start?!
I am a 26 year old American looking to relocate to Canada so I have been reading some of the posts he in this forum and also looking up information on the web. But I am very overwhelmed with all of the information and am not sure where to start. Right now I am living in Mexico with my mexican fiancee, we plan to marry shortly here. I guess my questions are 1. How easy will it be for me as an american to immigrate to Canada and how should I file. 2. Can I change my status from within Canada if I enter with only a tourist visa? 3. What are the chances of my fiancee being given a visa since he would not be considered a skilled worker? Any help anyone could give me would be very appreciated. Thanks!

1. unless you have been living commonlaw for the past year, you cannot include your fiance in your application. If you are married, they can be included regardless of how long you have been married but they will be required to pass medical exams etc.
2. go to www.cic.gc.ca in the skilled worker section and take the self test to determine if you qualify. Make sure you look at the expanded version of the NOC codes to be clear about job duties associated with each classification. Start to finish process is about a year under the new rules.
3. you cannot arrive in Canada as a visitor and change your status. Permanent status applications must be done from outside the country. Please be aware that while it is easy for you to cross into Canada as a visitor, the situation has recently become more complex for Mexican citizens. They now require a visa which means they will have to show substantial ties to home and convince CIC that they have every intention to return home to Mexico at the end of their visit.

Thanks for your quick reply. My fiancee will be able to pass medical exams and crimianal background checks etc. He has his family here in Mexico, a bank account with maybe 17,000 US dollars in it and two small pieces of land in his name. Would this be enough to show intent to return to Mexico? I will definetly look into the website you recomended. We intend to be here in Mexico for the next 6 months-1 year. aside from a tourist visa is there anything I can do from within canada? Would it be better for me to first secure some type of visa and living situaion and than try to sponsor him or would we be better off trying to get him some sort of tempoary work visa?

If you are legitimately wanting to be together - get married and then apply to immigrate as a couple with one of you as the primary applicant. Which one of you will depend on who has the best qualifications or points. This route will allow you to arrive together and you both can begin working immediately.

Forget all the other ideas of temporary visas etc. If you are not married or common law, you would not be given visas as a couple so it serves no purpose. If you want to come for a holiday and check out the country as to where you might like to live - by all means.

First question Meghan is, do you qualify as a skill worker?
Take the self assessment and see if you elegible.

Being an american doesn´t make a difference when it comes down to immigration. It makes it easier for you to visit Canada as a turist because you don´t require a visitor´s visa but that´s about it. You will be screened under the same criteria as everyone else.

Cheers,

Bill
