Hello, My name is Marcello and I am a 23 years old Italian. I have entered canada two years and half ago with a 90 days tourist visa and after that never get out, now my gf and I we want to get marry cuz we really love eachother and we are both tired of this sick situation. so, what we should do now ? should I get out of Canada and try to re enter with another tourist visa to marry her ? what if the immigration customer will know that I overstayed for that long here and will may deny my entry ??? Can we get marry without me to get out ?
I really need help ... Please ...

Go back to Italy and marry one there...there are many pretty girls in Italy..OR she can come to you in Italy and marry you there......if the whole matter is about genuine love..
However, if it is about exploiting marriage to stay in Canada, this is a different stroy..

Yes..you can get married and then resolve your status..she can sponsor your PR...

expect an inland sponsorship to take about 18 months, they will give you a very bad time and there is no appeal if they say no. Marry... go back to Italy and have her sponsor you from there. faster, and safer.

what do u mean with they will give me a very bad time while in there ? perhaps u mean that they will keep doing random check at home at anytime ?? well, if u meant that they can do it, my gf and I we already have been living for a year and half together and she is three months pregnant of me, so, this isn´t a fake marriage to get the PR, we are going to have a family soon :) ...
Btw, how long the processes will take if I marry her here now and after go back to Italy ??? Seriously I don´t wanna stay longer away from her ...

babies do not impress CIC. If you have been living common law she should apply now - but OUTLAND (even if you are still in Canada)
1) you will have to prove the common law relationship and the 1 year cohabitation
2) you will have to prove the relationship is genuine - baby is not sufficient
3) you will have to show that you are not using the woman to gain residency
4) Apply OUTLAND as soon as you can get your documents together and properly completed. Don´t rush this part because if you screw it up... it will take forever
5) you may have to return to Italy and come back but the time out of the country will not be significant
6) are you going to get this all done before the baby arrives - probably not.

Your last reply is scared me ... I am serious .. I can´t permit to not be present the time of my dear is having my baby, and I want to be close to her during the pregnancy ...
1 ) we have been living together for a year and half but, nothing of legal I guess cuz I was there with the visa expired which mean I was already illegal
2 ) how to do it ? we have got so many pics during the our relationship, in canada in many different places even in Italy with my parents ... would that be something for them ???
3 ) again, how can I show that to them if they don´t even care about the baby ?
4 ) I have to think about that ... I dont wanna leave my love alone during her pregnancy ..
However, I thought this would be easier, I have heard from so many people who have easily successed and gained the citizenship through marriage, even fake .... So, I think I need to hire a lawyer ...

you may want to consult a lawyer but don´t panic. Just be clear that sponsorship takes time and takes proof. first she must qualify as the sponsor and then you must qualify as the applicant. DO NOT DO AN INLAND APPLICATION.
the pics will be good - especially when they span a long length of time and they are with different people like you suggest.
they may care about the baby but making sure you are beside your partner for the delivery is not their concern. You have broken immigration rulse so you are not really in a position to dictate how and when this all comes about.

Its ok, Sharon was been very helpful .. So, I just wanted to ask the last thing, do the CIC has any clue about who overstayed ? I mean, how do they know if someone didn´t left the country if this person was never get caught or even stopped and has always paid in cash then never used own credit card ?
