Returning back to Canada - Please help

Subject: Returning back to Canada - Please help
Hi,
I have been working on H1 since Dec´06. Now my H1 completed and going back to Canada. My PR expires in 2010. If I say I have been staying in US for 2+ years.. will that be a problem for me? What questions could I expect? Any suggestions please.

To maintain PR status you have to reside in Canada for 730 days out of every 5 years. If you are a recent PR meaning you are in your first year and meet or can meet the above condition then you´re fine. Otherwise, also you are fine, as long as you can provide proof of maintaining the PR status.

No. It I am not in my 1st year. This is my 5th year as PR. I didn´t visit Canada in the last 2.5 years. Please let me know if that is a problem.

Did you read the post?
730 days out of 5 years. (ie 2 years out of 5)
if of the last 5 years you spent 2.5 years outside of Canada that would give you how much time in Canada???
Bingo you met the requirements.

Did you spend any of that time outside Canada with a Canadian spouse? then all days spent with them are considered days in Canada.
Did you spend that time with a Canadian PR who was working for the government of Canada or a LEGIT Canadian business?
then badda bing badda boom you spent those days "in canada" even though you were in fact not actually present in canada.

same goes if you spent those days with your parent who is Canadian (of course that would make you Canadian...unless you were adopted) or with your PR Parents who were working for the Canadian government or a LEGIT Canadian business.

there you are welcome.
stop freaking out now please.

PS be prepared to show proof.

As well make a detailed list of all the goods you have owned for the last 6 months or more that you are importing or re importing back into Canada as tariff item 9805 applies to you (returning resident)
Your items may all come in duty and tax free as long as you owned/used/and posessed them all for atleast 6 months. and no one item can have a value of more than 10,000 CAD.

If you spent that time with Canadian PR I meant to say with a Canadian PR SPOUSE.

spouse has to be a citizen to count when living outside the country.
