Subject: PRRA and H&C refused
  We came to Canada in 2000. We filed a refugee claim which was refused. We appealed which was also refused. We applied for H&C with PRRA in 2006. My dad (the main applicant) died on 31st December 2008. My family was called into CBSA office on July 30 because a decision was rendered. The decision was that both H&C and PRRA was refused but they did not know of my Dad´s death.

The decision was refused because we do not fall into IRPA according to the PRRA officer. Also, we failed to provide evidence and updates and provided the same risk as our refugee claim (Something our consultant failed to tell us). I was 9 when I came to Canada, the officer wrote that I will have no problem re-adjusting because I have "experience"? I wasn´t even aware of the things that were going on around me when I was that age. As for my younger brother, he would face difficulty. That is what the PRRA officer claimed.

I have been living in Canada for over 9 years now. I´m a teenager who grew up here (came to Canada when I was 9). I am a full-time student here and I just completed High School and was looking forward to attending University next fall to obtain a degree in Political Science. I have a younger brother who grew up here. I cannot read/ write in the language of where I came from (India). I studied here, I have friends here and if we were to go back, I cannot adapt there nor can my younger brother.

My mother has no relatives or family in India (Her brothers and sisters are in the U.S). My mom has cousins here who help us. We have no home in India. My father died here paying taxes, working full-time and had his own business.

Our passports have expired so we cannot be removed until they are ready. Are we able to apply for a appeal so we can provide the new information which they failed to receive or consider? Is there anything we can do? I don´t know anyone there. I will be visiting a lawyer soon, but right now, I´m very worried.

Your options are to apply for a deferral of removal which is only a letter once they say bring us a plane ticket. Then file a stay of removal @ Federal Court based on some of the factors you mentioned.

If your in the Toronto Area you can call me and if you want I´ll recommend a reasonably price quality Lawyer. Not my 800 number.

hi there...
me and my wife get deported to India under enforced removal order after failed refugee claims, PRRA, H & C etc... we left canada on april 5th 2009.
I heard about ARC but don´t know how long it takes and how long I have to wait to file an application for ARC I mean is there any time limit I have to follow before filing an application for ARC? what are the procedures, and how can I make my ARC effective or successful. can I submit my ARC anywhere or I have to do it in my home country? should I expect any hope to settled back in Canada or try something else? any help appreciated in advance.

You have to first explore how you wish to immigrate to Canada, skilled worker etc. ARC will facilitate your entry if you meet the requirements.
If you wish to apply for ARC just for the sake of returning to Canada, you are allowed to do that but doubt you will be issued one. You have to provide a good reason why you need to return to Canada. If it is for work, then apply for a work permit from India ...

My Canadian ex-wife applied to sponsor me for permanent residence, then withdrew her application after I received first stage approval. I have joint custody of two Canadian citizen children, ages 4 and 6, and letters from their pediatrician and day care provider attesting to my importance in their lives. I am a US citizen and I have been in Canada since 2001. I currently have a temporary resident´s permit and I am preparing to submit an H&C application for permanent residence. I have been involved for two years in a relationship with a woman who refuses to marry and sponsor me, even though we have great affection for one anther. I work as a web-based translator, so luckily I am able to support myself legally without a work permit since all my clients are outside Canada. What are the chances of my H&C succeeding, based on the needs of my citizen children? Should I consider getting out of my current romantic relationship in hopes of meeting a woman who is willing to sponsor me? Thanks.

Hello dear

My refugee claim in CANADA was a NEGATIVE one.
I was not told by my lawyer about the possibility of applying for a PRRA.
The removal officer explained this right to us (family of 3) and we must decide to accept(apply) or to continue with removal (leaving the country voluntarily).
I am facing an ultimate risk of being kidnnaped in my country for sure asap I get back.
1. Shall I apply for HR at the same moment that I am applying for the PRRA. ?
2. Please someone describe me the experience of removal in accordance with your own experience?

Hi there!

I was deported to Lebanon under enforced removal order after failed refugee claims, PRRA but i got married in Canada before i leave and now my husband is sponsering me I received an email form Damascus office that i have to apply for the ARC i need help on what should be included in it and is there a formel way to write it they didnt specify and honestly im a little worried coz im not that good in writing letters specially one as important as the ARC and since they asked for it does that mean that my PR application is being approved?? i need help plzzz

hi three... my wife sponsor me she is canadian.the immigration refused my sponsorship case.me and my wife live to ghater last 9 month.the immigration send me mail we refused your case beacuse me and my wife not live to ghater.can i do appeal now?now i am in toronto i dint get prra yet.if i do appeal cbsa send me removal order that appeal can stop my removal order,,plz help me

HI THERE , my wife is canadian she sponsored me . the immigration refused my sponsorship case . me and my wife have been living together since july 8th 2009 . the immigration sent me a letter stating that they refused my case because they dont believe that we are living together . can i do an appeal ? we are living in toronto . i didnt get my prra yet . if i do an appeal can the appeal stop the removal order ? please help me . thank you
