Subject: Regulation 179
  Hello,

I am trying to attend the Adventure Travel World Summit from 19th to 23rd October 2009 in Quebec Canada on the behalf of my own adventure company Ace the Himalaya www.acethehimalaya.com My company is privately owned by me from last two and half years , I am the member of Adventure Travel Trade Association as well (who is the organizer of summit in Canada)

Yesterday on 10th August 2009, I received my passport back from Canadian High Commission New Delhi without stamping visa ( I only requested for 6 days temporary resident visa). The following reasons was given , please advice what to do. I had explain my situation for each factors as well.

1. You have not satisfied me that you meet the requirements of Regulation 179; that you would leave Canada at the end of the temporary period if you were authorized to enter. In reaching this decision I considered your ties to your country of residence/citizenship balanced against factors which might motivate you to stay in Canada

2. You have not satisfied me that you would leave Canada at the end of your stay as a temporary resident in reaching this decision, I consideration several factors, including:

a. Your history of having contravened the conditions of entry on a previous stay in Canada (I was applying for first time to visit Canada)
b. Your travel history (I have been to couple of Asian country such as Singapore, Malaysia, Thailand etc)
c. Your immigration status (I am from Nepal)
d. Your family ties in Canada and in your country of residence (I dont have any one in Canada, I am married man with 3 years old son living in Kathmandu)
e. Length of proposed stay in Canada (I applied only for 6 days visa, my return ticket was with my application)
f. purpose of visit (It was to attend the Adventure World Summit, I submitted the invitation letter from ATTA and hotel booking confirmation from Fairmount in Quebec)
g. Limited employment prospects in your country of residence (Dont know about this but I have in my own business from last two and half years. The business is being really good)
h. Your current employment situation (I have provided all the documents of my company Ace the Himalaya which is my solo company)
i. Your personal assets and financial status (I have submitted the evidence of currently having $ 70000 bank balance with much bigger bank transaction plus my property including my own house and land in Kathmandu which is worth of CAD 300922.53. May be it was too much?) .

I will only reapply, if they can guarantee me to provide the visa because I am not willing to pay visa fee again for no reason. Do you people can give any advice as I really wish to attend the summit as I have paid the summit fee already and been arranging pre-meeting with couples of attendee via e-mail already. I don´t believe the reason is true. I think the Canadian high commission did not try to contact ATTA or even my company to get further information while processing visa. They think purpose of my visit to Canada is not genuine. I don´t know how I can satisfied them that I would leave Canada at the end of the temporary period if I am authorized to enter. I have my own deluxe life in Nepal, having my own cars (three of them), drivers, house, well running business, my wife and son. Why do I live in Canada? For what reasons? My question is how much should plan on spending in Canada for six days stay?

I look forward to hearing from you soon. You can personally write me at prem@acethehimalaya.com To get more information about my business visit www.acethehimalaya.com

Regards
Prem

Regulation 179 (in reply to: Regulation 179)
We are a Filipino family living in Bahrain for more than 18 years now. Our children are studying here, and we just decided to take a break to attend a reunion with my brothers and sisters who had been in Canada from the ´80s. The reunion requested is just so we can celebrate the 20th death anniversary of my parents.
I think we submitted all the requirements that may allow us to visit Canada even just for 18 days maximum as we plan to arrive 11th August and depart on the 29th August.
My husband and myself are gainfully employed in Bahrain, based on the employment documents we submitted as well as bank statements we attached; copies of bank certificates available and so on; and wouldn´t need to battle it out in Canada; cause if we would have wanted to, we should have done that in the early ´80s.
Despite of the information and documents given along with the invitation letter from my brother and his family, the statement is:
You have not satisfied me that you meet the requirements of Regulation 179; that you would leave Canada at the end of the temporary period if you were authorized to stay. In reaching this decision I considered your ties to your country of residence / citizenship balanced against factors which might motivate you to stay in Canada.

After sending my application and the refusal of entry, we are not pursuing our application this time, but please let us know, on what grounds, we were denied our application.

Thanks, Mary

there is nothing to inform. You are required to explain the nature of your visit. CIC talks about intentions to return home on their website. You have not satisfied them - try again.

i have submitted all the documents but they rejected my application saying that i dont meet regulations 179.do i have to buy ticket also to make them sure that i will be coming back.one more serious thing i have to tell u that the canadian goverment is not capable of handling the people they dont no how to exit the people after finishing there visa that is affecting like me guys who spend lot of money and suffers lot really it is very painful that i can not meet my family after 10years bcoz of this problem.they should upgrade there system.bcoz it make canada a worst country to enter.sorry to tell this things but it was in my heart bcoz today morning i got up and i received rejected visa.

Rejected Visa (in reply to: Regulation 179)
I had the same problem. I applied here in Saudi Arabia for a visit visa.

I received a rejected letter because of regulation 179. I have been working here in Saudi for more than 10 years. I have submitted them all the requireements i.e. bank statement, employment certificate, invitation letter from a canadian friend.

I feel it´s unfair. They should contact our company if we are employed to verify if we are on holiday.
