Subject: marrying a japanese woman
Hi, i´m planning on marrying my gf who is currently living in japan. She´s planning on coming to visit me later this year. But i´m going to visit her in november. Now what kind of things do i need to do after we get married. i´m not sure exactly how things work and i want her to be able to live in B.C. with me asap. Any suggestions on the process or steps i need to take to make this happen?

MIKE

What kind of things do I need to do after we get married?????

This is an unusual morning!

Well you made me laugh.

You are in a Do It Yourself (DIY) community.

Some people can lay interlock brick to expand their driveway without weeds growing up through the bricks in two weeks and others can NOT!

Some can finish a basement without setting the house on fire and others can NOT!

If you have to ask that question I think you need to retain someone who can assist you properly. Remember she will be your partner for a LONG time. She should be worth it.

Retain (anyone) who will provide references, can prove experience, who will follow up every step, solve what ever problems that may arise & be allowed to communicate with the Visa Post after submission. Make sure that they are aware of every obscure regulation or condition that might affect your application.

The time saved hiring an Immigration Practitioner. Priceless!

The difference can be interviewed waived and she is here in a few months or your partner could be sent for interview several months later.

Then you will be back here asking what questions will the Officer ask.

At the Interview. If your partners answers are illogical or do not match with your forms your wife could be refused.

Any outside of Canada Spousal Application can be appealed. Pay some one who is GOOD & REPUTABLE now instead of later to fix your mistakes.

Time Line for a Spousal Appeal

Three to six weeks to get the refusal letter.

File your appeal and Hearings Office has 4 months to get the record from the Visa Post. Then the Immigration Appeal Division assesses the record and decides whether to allow you an ADR Alternate Dispute Resolution or you appeal will be a full appeal. That takes at least four weeks.

Getting a date for a Full appeal can easily be a year and a half from the date you submitted your spousal appeal or TWO + years from the date you got married.

Now if your west of Ontario double those numbers.

Mike I am not trying to scare you my own wife has been on vacation for five weeks and I miss her soooooo much. I also have spouses calling me every single day including Sunday and crying about CIC processing times. About the IAD taking toooooo long to set a date for the appeal.

Many can DIY but I have my doubts about you and I could be wrong. The question you have to ask is it worth it to be able to rest a little easier while the processing is going through. That is a personal decision you will have to live with.

Either way I wish you all the best.

actually i was wondering. after we get our marriage certificate. how long can she stay in canada? I live in B.C. and i was told that she can stay as long as she wants. but she can´t work until the approval for permanent residence hasgone through. apparently there´s also a process that she can apply for a work visa? all we need to do is pay for some processing fee? is that right?

No, she cannot stay as long as she wants. You should start the process for permanent residence while she is in Japan.

Start here:

Bill am I wrong or do you have an opinion from Mike´s comments that he should or should not hire someone to assist him? Just wanted your honest opinion.

Will be swimming in the suds this weekend.

Without a visa, she´s elible to stay at least 6 months. at the mean time that would be good to have the documents filled and sent out. she´s planning on flying back to japan in jan 2010 to settle with the things there. so hopefully the process goes nice and swiftly.

Roy,

I think he should or do a far better research of what it takes to fill all the proper forms to start an immigration process. Without that she might not be able to enter the country and if she does, things may go south pretty fast.

Mike,
If you do so, make sure that you fill an outland application. If reading and filling forms are not your forte, I would highly recommend you to look for help.

Cheers,

Bill
