Spouse is HIV positive

Subject: Spouse is HIV positive
  My husband is HIV positive. He is not sick and is on Meds. Will he discriminated against due to his status in Canada?
Will the immigration offices deny him entry due to HIV?
He is an honest and hard working man. I knew of his status prior to marriage. I know ignorance exists and some people may say I am crazy etc - but he is my husband and I love him for the person he is regardless.

Please advise... I hear horror stories of real relationships being denied as fake ones pass through... I am afraid of us being denied the right to be husband and wife in the same country.

I am afraid I do not have answers to your questions but just wanted to put in a few words of encouragement: Stay true to your conscience and keep being good. If your marriage is for real, then it is for real. It is well.

Thank you... It is real, I never second guess that... may be a bit too real for many minds. I just pray for no delays.

I confirmed: HIV spouse is admissible. Canada has a fair human rights law in place to allow HIV spouses entry.

If you are sponsoring your husband then he is exempt from excessive demand on medical/social services condition. He´ll be asked to report for medical surveillance once he lands.

If you are applying as Federal Skilled Workers, you´ll have difficult time passing the medical examination. However, if he is not on ARV then he may pass. No guarantees as the decision is made on case by case basis.

I also wanted to know - if he applies for an extension on a visa longer than 6 months will he be denied? I would guess not since it excludes him. He also wants to work. I told him he can relax and I will bare the financial burden since I can provide for both of us - my income is enough for a family of 5 according to the website... we are a family of 2.
The extension will be to make sure he is here during the process.

Have you gone for outland sponsorship process? If you have then you should be able to receive a decision in 6-8 months. He can apply for extension and he can stay in Canada under implied status till a decision on his extension application has been made. No one can predict whether his application will be approved or not, as being married to a Canadian spouse does not automatically gives you the right to stay.

Hi Samm, outland timelines are the same as inland for his country. I want my husband close to me during the process... Maybe I am just an over protective Wife but Inland would be my pick and I will endure the financial burden as we wait for his OWP. Thanks much Samm.
