How it happens.


SCENARIO # 1

You arrive and make a refugee claim and receive a negative decision a couple years later.

You file an application for leave to appeal to the Federal Court trying to prove the Board Member erred in Law.

The odds of this being successful is under 1%

You (stay) dreaming that something or someone will come along who has a magic wand. Since you stayed your (conditional exclusion order) at the time of making your refugee claim now becomes a deportation order.

You submit an Humanitarian and Compassionate (H&C) application. You wait more.

CBSA calls you in for a Pre Removal Risk Assessment PRRA which basically buys you more time and only NEW evidence since you lost your refugee claim and your order became effective will be considered.

Then CBSA calls you back in to get your decision. Surprise it is NEGATIVE!

Having an H&C in process will not prevent your removal.

Having an In-Land Spousal in process submitted after being called to the PRRA will not defer your removal!

You will get a few days to bring in your own ticket or told to leave on flight # ____ on the ______ of the month if the government is paying for your flight.

SCENARIO # 2

You arrive as a visitor. You apply for an extension and are refused the extension of temporary status. You receive a letter requesting that you leave immediately voluntarily and if not enforcement action may happen.

Three more months go by and you get stopped in a ordinary traffic stop. You now have an automatic DEPORTATION Order. You get offered a PRRA and after you apply like above you receive a negative decision.

Once your given a specific date to leave you can submit a request for deferral of removal based on a particular common sense reason. Chance of success NOT GOOD ODDS.

When your request for deferral of removal is refused you can try to RUN to the Federal Court which is REALLY NOT GOOD ODDS.

Of course there are other ways to get deported like being a criminal etc.

This means that the spousal sponsorship of a bogus refugee claimant is a way forward and "guarantee" if it was submitted before called to PRRA. This is where the ambiguity and loopholes stand. This is where the people know very well how to use and abuse the immigration system and drain the resources.

When you posted about "broadcasting of bogus marriages stories" I responded to you saying "I know, in person, cases bogus immigration like the above scenario that should take more attention and exposure than what we call bogus marriages.

The issue is should someone who has been in the country for three, five, six or eight years be able to defer their removal if only after they are called to a initial PRE REMOVAL RISK ASSESSMENT say (will you marry me) be allowed to defer their removal. NO!

The deferral of removal due to an In-Land spousal application is until the spousal application is reviewed and is a matter of Public Policy for any and all spousal applications submitted BEFORE being called to the PRRA..

If it looks bogus, smells bogus and walks bogus it should be bogus.

Proving a marriage is bogus or real is no easy task.

Making sure your rights are upheld and that you try every avenue is your right.

All I was trying to do is provide information on how one can get deported and their options if ordered deported.

The scenario is like this: a man hooked the Cnd PR or citizen online, fell in love from a distance...then Planned to get to Canada. The easiest way is to claim refugee...got married in the first few weeks....woman got pregnant..woman has his child. Sponsorship application inland was submitted long looooooooooooong loooong before PRRA stage. Does it walk, smell and look bogus?

But then again, the distressed applicant, if smart enough, can find me and enlist help! 5k US gets the ball rolling and the removal orders SHALL be put on hold until the case is properly and fully resolved, which means the refugee status is granted! Case closed. Henceforth, the refugee will have to work!

Hi all,

Just a quick question, this may seem way out of the ordinary but how do I go about getting myself deported from Canada? Who or what do I approach to declare myself an overstayed visitor? Thanks a lot.

I wonder If there can be a deportation act in a house full of people who is actually telling they have an expired visa for more than a year? They work and live here, not really respecting some rules of the neighbourhood like stopping their music after 10:30pm. They work, they don´t pay taxes, they laugh in front of you and they even think they are better than you and then they disrespect you with neighbours and take away available works because they are paid one or two dollars less than someone who paid for the PRC or who is actually a Canadian Citizen. I wonder how come they are still here? Is it fair? on 1301-1315-Davie street?

How to find out if someone was deported (in reply to: Deported, how it happens.)
My wife´s father came back to our Caribbean island recently. He called a month in advance to say he wad on his way home on a specific date. When my son whent to the airport to get him he could not find him, when he asked an immigration worker where he washe was told that he had been deported so he was wiht an immigration officer. My fether in law however swears that he was not deported, and that he is going back to Canada soon. How do we find out if he was deported. is there a list or someone we could write to.
