Subject: Sousal Appeal Preparation

The Visa Officer sometimes finds unusual circumstances not well explained in the spousal application and sends the applicant for an interview. Some applicants get sent for a spousal interview for some glaring errors & omissions or out right lies! Others get sent for a spousal interview for the most ridiculous reasons one can imagine.

Everyone must understand accepting a spousal application is genuine or bogus is a judgment call. It is the applicants and sponsor´s duty to be prepared for a possible interview regardless of how logical your relationship is or isn’t. Do not wait until you’re called for an interview to prepare yourself for the spousal interview. Start preparing yourself for a potential spousal interview before you submit the forms to the applicant´s visa post.

I would suggest hire an experienced, quality representative who will provide several references from former successful clients. It is all the little things that they can correct that could keep you two from sleeping under the same roof for some considerable time.

If you decide to (DIY) do it yourself I strongly suggest to find the most negative thinking person possible that you know to review your application before you submit.

If you’re invited to a spousal interview review your forms at least twenty times. Focus on your plans for the future which hopefully you have already started. Know almost everything about his/her friends, hobbies, occupation, supervisor’s, parents and siblings names, etc. Know where the siblings reside and which one is married and how many kids they have.

If you rushed into this relationship or could be accused of same have your answer ready. Saying your grandmother was married for fifty years and got married within three weeks of meeting her husband means nothing. If no one traveled to his/her country for the wedding don’t say they were too busy to come especially if it is your first marriage.

Be able to answer how your partner gets to their work and how long it takes them to get there.

Remember we are all different and normally one partner is Martian and the other is from Venus. We view things with different sets of eyes.

If you are refused write down immediately any areas of concern the Visa officer told you about. Remember if refused it is partly your fault! Like I said earlier some times the reasons for refusal are illogical.

File your appeal and order the CAIP’s notes to see for yourself what the Officer claimed was the reason for the refusal. Start compiling evidence to overcome any area of concern raised by the Visa officer in the CAIP´s.

Don’t blame each other – you’re both at fault for not submitting a quality application. It is time to solve the problem not point fingers.

Defend your application based on the evidence you compile and try to keep emotions out of your preparations. Put together your submissions and index and number the pages. Make it organized by showing pre-marriage relationship photos, tickets etc. Marriage photos then honeymoon and second or third trip photos, evidence, etc.

CBSA will take four months to get the record and then depending on where the sponsor resides is the factor on how long the wait time will be. If you submit your evidence for the appeal according to the IAD rules it could be the determining factor on being granted a ADR or a Full hearing. CBSA & IAD normally just look at the record but each office is different.

Winning at the ADR stage is based solely on the Officer believing that one of his/her colleagues would not be successful if your file went for a Full Appeal Hearing.

Not being granted an ADR Alternate Dispute Resolution and being sent to a full appeal means you really need help.

Remember your partly at fault so focus on the reason for refusal to win your appeal.
