  may I suggest that the advice you already got from your lawyer is probably the best advice.

How and when did your husband get himself to Canada? Is he a visitor who forgot to go home? What was his reason for coming in the first place?

Something is flagging CIC to your husband. Perhaps the officer should have kept his comments to himself but like it or not, there are immigration schemes that are more commonly used by certain ethnic groups - a fact is a fact and it has nothing to do with being racist. I live in the Vancouver area. Asian immigration schemes are legendary around here. It is so prevalent that people don´t even attempt to hide it. And the people that use these schemes are often ineligible any other way to immigrate and regrettably they sometimes bring ilegal activity with them. CIC has every reason to be cautious.

Your husband has been on a removal list for almost a year. How long have you been married? What do you know about his life in China? The fastest way you are going to get this resolved is to have him return home, sponsor him as an outland applicant and have him arrive legitimately. He has already broken too many rules to get any special consideration.

I knew about his family, and even though we´ve been married only for one year, we´ve been living together for 6 years. I do agree that CIC need further inspection over our sponsorship case, but i still feel what that officer did to my husband is inappropriate, starting from tricking my husband into getting "emergency document" so that he can never come back to Canada.

Anyway, really thank you for your advice though.

I suspect he has been asked to leave the country more than once in the last 6 years and has not done so. Getting tricked my be the way you see it, but CIC may say that they did what they needed to do to enforce the law.

only once, which is the departure order, the time that he failed to show up in the court of refugee application ( tricked by wrong counsellor, long story ...)

i do hope everything could go well, well, hope for the best, prepare for the worst.

my question is if my husband decides to go back, should I cancel the inland spousal application and apply for outland, or keep the inland?

DO NOT APPLY INLAND. DO NOT DO NOT DO NOT. If you are refused, there is no appeal - none. The application takes over twice as long to process. BAD DECISION in your instance to apply inland.

did I say it strongly enough? Inland would suggest your husband is trying to avoid leaving the country. BIG MISTAKE. Even if he is currently in Canada, apply OUTLAND

...inland application has already been picked up by CIC and a letter indicated to us that it already went to local office, 7 months too late.

So should I cancel the current one going and apply outland?
sigh, should come here earlier...

As Sharon said, OUTLAND. One thing to keep in mind though, even if the inland or outland application is still in process this will not stop the removal order.
He can still be removed from Canada.
