Subject: sponsored nanny 4 months pregnant
Our live in nanny just informed us that she is 4 months pregnant.
She kept it hidden for fear that she would be fired, and says she intends to work up her doctor says she shouldn´t and that she will take a month off after the baby is born.
I am concerned for her and her babies health, she is here through the government live in nanny work sponsorship and has no means to raise a baby here in Canada.
She plans on having the baby in Canada so it has Canadian citizenship, then sending it to her home country to be raised.
What are the legalities involved in this type of situation?
Maternity leave?
We will have to hire someone else while she is off, does that mean we have to sponsor another person or is that even possible?
Anyone dealt with this?
It´s very disconcerting, we really care for this girl and we are worried about the emotional consequences that her current plans will have. Helping her raise the child just isn´t an option for us.

this is the link to be eligible for maternity leave.

as far as care for your nanny is concern, why dont you talk to her of what is fair for both parties? but if she begs to work during pregnancy, why dont you give her a chance? who is going to look after the baby if she resumes to work with you?, or does she have any relative here to assist her...she must be very anxious of whats ahead, but you may settle it by communication.
while she is off, she may refer somebody to relieve her, somebody whose permit is OPEN. because if you will get somebody just for a month or two, sponsoring AGAIn is a long process. there are lots who are looking for job.
try to put yourelf in her situation. if you really need a replacement, because she is pregnant, that is another issue. you may search it out here.

Thanks for the quick response, the link didn´t show for some reason, can you resend?

We are more then willing to give her the option to work, we don´t have any alternatives either but I´m not sure if she feels she has any choice in the matter, and I suspect she´s feeling sub par as energy goes.

She is back with us today and I will be addressing these issues and try to get to the bottom of what she really wants to do.
I am not aware that there is any relatives willing to look after the baby if she resumes work. The boyfriend is not an option, he already has commitments but has said he will support the child, and she said that the child would be sent back to be raised by her mother.

You should consult your local employment standard branch or labour rights advocate to review what will happen to YOU if she injures herself on the job. Also there will be some tasks that may not be possible for her to do - how can the two of you accommodate that? Then put in a contract the issues you and your nanny may face if something happen - can never be too careful.
