Subject: Is a US Marriage recognize if person is not legal
  I have been dating my boyfriend for almost 2 years. He currently lives in Florida but he is there illegally. We have decided to get married. What I need to know is if Canada Immigration law will recognize our marriage as it will be done in the US and he has no legal status there. I am a Canadian citizen. My boyfriend does not want to go back to Colombia as all his family lives in Canada and in the US. Can someone please let me know if I will have problems by getting married in the US?
In addition, my boyfriend used to live here in Canada, but unfortunately his refugee claim was not accepted (only his mother´s was) and he was deported to Colombia.
I am desperate and need some guidance. Please help. Txs

I would check with an immigration lawyer. CIC is going to think you got married so he could find a way into the country. The deportation order might pose some problems for you. I would know what you are up against before saying ´I do´

Actually, I had a similar situation, and I spoke with a very good immigration lawyer in Toronto. He said that deportation orders are no big deal. If he has commited any offenses such as theft or assualt that is different, but normally, deportation is not considered a criminal offense. Also, no country will let you get married when you are illegal. You will have to marry him in Colombia, and then sponsor him to come to Canada as your husband.

As for Sharon.....why do all of your responses involve "being careful" and "know what you are getting yourself into??" Marriage is not a joke and if they are truly serious about each other, then why do you always question it??

Ohhh if the guy leaves US and goes to Columbia for marriage then he is stuck there because he is illegally staying in US.

Only if he can reenter US illegally to continue his lifestyle then its possile to go abck to Colombia and get married... Which I do not thik is that easy...

Anyways... It may be tough for you to get married in a third country where you both dont belong to. I mean you have to register your marriage with the "Authorities" and since your boyfriend is illegally staying, the marriage registration authority people will have trouble issuing a marriage certificate.

Another option will be if the Boyfriend´s family are immigrants in Canada (even on refugee claim and if it has passed) then they can sponser him and he can come legally here in Canada and then you guys can be togather..

I say be careful because a very good friend of mine married the man of her dreams. She was in Canada, he was in Czech Republic. everything was on track for a happy life until they started down the road to sponsorship. Turned out he did not tell her everything about his life (who does when the romance is new and you want everything to go well) He felt it was not very important at the time to tell her he had a small criminal record. 3 years later, my friend was still getting nowhere with her sponsorship, was finding out more ugly things about the man of her dreams, but was stuck in a transcontinental marriage. She had a business in Canada and was not in a position to pack up her life and move to be with him.

While she is working away at sponsoring him (spending hundreds of dollars)... he is lonely. (you can figure out the rest). Now, she must spend thousands of dollars to go get a divorce in another country. It has been hell on wheels.

Her advice to me and others...be careful.

Hello

Txs a lot guys for your replies! It helps a lot to know that there are people like you that are willing to give some guidance to people like me..

I had my concerns about us not been able to get married is the US. The possibilities of him going back to Colombia are very slim. Like I said he has no one in Colombia and to go there and come back is not possible.

Would things be different if he had a refugee claim status in the US?? How advance would it have to be in order for them to let us get married??

Is there anything else that I can start checking or doing in the mean time???

Once again, txs for your help and if you know of a good lawyer, can you please send me his/her information.
