Subject: Leaving Canada while the PR process
  Hi there,
I´m in Canada now, and preparing for the PR process.
My question is that if I´m going to apply for the PR inside Canada, can I leave during the process?
I´ve heard so many different possibility, but no one can really give me a for sure answer.
If I´m in Canada with "multiple entry visitor visa," and I probably have to go back home for a short time during the PR process, is it possible?

I´ve asked the very same question awhile ago and the response I got from one member made a lot sense to me. Basically what that person said was if you were to leave after you filed for PR, the chances of CIC officer letting you back in was slim. Cuz the purpose of visit visa is to stay temporary and you have showed that you have no intention to leave by filing PR. So, what likely to happen is that you probably be refused for reentry at port of authority. Anyway, I have set up an appointment with an immigration lawyer in next week to discuss my problem. If I don´t change my mind and meet the lawyer as I plan, I´ll ask that question for you.

Hi all.I am a new entrant to this forum. Would request you all to help me with a few concerns.
1. My fiancee is landing in Canada next month on a PR. Just wanted to know how does a new immigrant get his PR card? Does he have to file an application or it is an automated process. Also is there any way in which we can expediete the PR process for a first time applicant
2. We plan to get married soon so one question that comes to my mind is should i join him to Canada on a visitors visa and then get married there or should he come back after his PR card and then we get married?
3. Say we get married after he attains his PR card - can i go with him on Visitors visa and then apply for a PR from Canada or should we apply for a spousal case from India?
Really looking forward to your replies to my concerns.

I met a lawyer today and he said the same thing like I said. If you leave the country after you filed PR under H&C category, it is very likely that consulate will not issue you a visa to get back in. Even if you do manage to get a multiple entry visa while you are still in Canada without needing to attend an interview at buffalo office, you probably be refused to get back in at the port of entry when you come back from your home country for you have proven that you have no intention to stay temporarily by your H&C application.

So, the bottom line is, don´t go back. Wait till you get yourself a PR status. Sorry to break you the bad news.

First of all, I want to thank you for spending time explaining after the meeting.
Thank you very much!

Actually I phoned cic´s toll free no. and finally got someone to talk to me, and I explained my situation to her.
She actually said that the custom has to find a good reason to block people from coming into Canada, since we were under regular procedure and doing everything by the book.
There´s no reason they won´t let us come back to Canada again.

The other thing is that I´ve had my multiple CA entry visa already, which I applied for the first time coming into Canada.
I don´t have to go to the immigration and request for a new one.
If this is the case, would it be easier to return?

I´ll try to phone them again to get further information, and I´ll get back to you asap.

I don´t want to sound discouraging but do bear in mind that nothing is hundred percent sure. I seriously doubt, as a visitor, you would be given a chance to argue at the port of entry if they decided to send you back. The fact that one of the grounds of H&C is hardship you would experience if you were to back, I don´t know how this gonna affect your application. Believe I know how much you want to leave. It just a waste of time to wait for the status for like 4 years without having the right to work or do things that other people can do. So if you do want to go back, go back. But be prepare for the worst.

Hi .. I hope u can help me .. I just applied for my Open work permit and PR last dec 2010 .. Iam planning to go to my homeland this nov 2011 for 2 months..am i allowed to do that? Will it affect my application? What are the possible consequen es if i did go back home?

2. your Fiance needs to land and get himself a job. IF you can get a visitors visa, you can get married in Canada but be warned, an inland application for your residency could take over 2 years.

3. DO NOT GET MARRIED UNTIL HE HAS FORMALLY LANDED. Any change to his marital status now will require him notify CIC. If he marries you and lands without notifying CIC, (to keep his life simple) he will be guilty of misrepresentation and could lose his residency. so DON´T DO IT!

Best bet - he lands, he returns to home country and gets married. Returns to Canada and begins sponsorship process. Yes, it means living apart but the timing provided does not offer too many other options.
