  Hello there,

I am a PR of Canada and applied for Citizenship in Dec 2007. I unknowingly made a big mistake to send in my application 4 days early thinking that the mail delivery will take approx 4 days. I took the citizenship test (Toronto) in September 2008. They asked for a long questionnaire which I sent to them in September 2008 as well. It has been 14 months since then and there is still no news. I called the call center and they said that it will be between 12-18 months since they received the questionnaire (March 2010). I would think that I passed the test but the call center did not give any information. My PR will expire in October 2010. I sent them letters asking for updates and if I need to send any additional documents but they never reply.

I will really appreciate if someone could shed some lights into my situation. What is the procedure here now? What should I do? Do I need to reapply? They never told me to reapply yet BTW. When could I possibly hear from them? I will really appreciate someone´s assistance in this regard.

It sounds that the 4-day mistake was a big issue for them.. Also, there may be other issues as appear from sending the questinnaire eight months from the application date and the significant delay in the processing. These things happen if they question your history or your residence OR when you apply earlier than the perioid required.. However, I think as long as you are not referred to a judge, you will be o.k. I expect you will be referred to a judge soon, though.

If you have fewer than three (3) years (1,095 days) of physical presence but at least three (3) years of basic residence less time served, the citizenship judge will evaluate the nature of your residence in Canada. However, your application will take longer to process and may be refused.

If you apply with fewer than 1,095 days of physical presence, a citizenship judge will evaluate the nature of your residence in Canada. You will be asked to complete a residence questionnaire and provide evidence that establishes residence in Canada, and you might be asked to appear in person before a citizenship judge. When you apply with fewer than 1,095 days of physical presence, your application will take longer to process and may be refused by the citizenship judge.

Deciding to apply with fewer than 1,095 days of physical presence is a personal decision that should be made carefully and take into account your personal circumstances.

Thanks for your comment. Do you think I should cancel my application and reapply? They never told me to reapply by the way. I guess they should have canceled my app in the first place and advised me to apply with 1095 days.

In a worst scenario, if it is going to be a refusal by the citizenship judge, I can still extend my PR and then reapply, right? I cant think of any valid reason for refusal though. I have been living in Canada since 2001 and already have enough ties including babies born in Canada and ownership of property.

Do you have any idea how long might the procedure take from now? Is there anything that I can do to expedite the procedure, i.e. Can I go the processing center and see someone regarding my situation?

Ash ... you mean to extend your PR Card, not PR. PR status does not expire. You do not need to extend your PR Card unless you are thinking of travelling.
And unfortunately, you are in a bind now. It doesn´t make sense for you to re-apply because you have already waited so long. Applications that needs to be reviewed by a citizenship judge will take a long time because there are not that many citizenship judges in each province or across Canada.
Contact your MP for assistance - provide a good reason why you need your file expedited, as long as it´s not stuck in security background checks, it may be doable.

Thanks a lot PA. I meant to extend/renew the PR card for traveling purposes. So, I can still extend/renew my PR card right?

Ash - it´s MP - your federal representative. Your MPP is your provincial representative, no use for this purpose. Yes, you can renew your PR Card anytime close to expiration or after it expires. If you don´t have a compelling reason to provide to expedite your file, try asking them to get a status update, at least you will know what is outstanding.

Thanks PA again. I sent them 2 letters already asking for an update, one was almost a year and the other one almost 6 months ago. No replies.

Ash - call him / her office directly. I find the first contact by phone or drop-in is good. By phone, you can obtain a direct email address to email your information to.

Hey PA,

Who are you referring to here: the regional processing center or the MP´s office? The letters I sent were to the processing center (asking for status update) not to the MP. Could you kindly clarify?

Does anyone know, in situations like mine (early application) does it actually always get refused or accepted?

Ash - You should go to your MP and get him / her to request a status update on your behalf. Processing centre has no obligation to respond to your inquiry but must respond to your MP. My friend, like you, sent 3 letters in two months and got no response but through her MP, she got an answer in less than a week. Hope this is helpful.
