Subject: creditor's taking legal action from US
I am about to move to Canada under 2yr temporary work visa to work for a canadian company. However a debtor in the US has just indicate to them that they are starting legal action to collect on the debt. I will be in Canada before the legal process officially begins.
How is this affected once I am in Canada? Can the US creditor garnish my wages in Canada. Will the US creditor even be able to know that I am in Canada. Can I be criminally charged if I move out of the country and don´t inform them?

I don´t think you can run and hide that easily. banks and credit card companies share information. it might be wiser to make peace at home before bringing your problems across the border. we don´t really want them!

Sharon,
It´s the like of such langauge and attitude that got everyone to hate you on the forum. I mean are you the immigration agent at the border post assigned with responsibility to judge what is correct and not and who should be admited and at what point? If you don´t have the right answer or don´t like a portion of forum questions, better abstain yourself from it then being a egocentric; attention-grabbing person.

I guess by "we" Sharon meant "Kat". She was just trying to put herself in Kat´s feet and explian her point of moving to Canada with a problem. It is true that Canada, US and UK have an inter-linked banking system and any fraud conducted in any of these countries could easily be traced down in other countries. So, I guess Kat would probably don´t really want them.

dear Kat...

I do not think that a US company can garnish your wages in Canada. That said...you will likely have problems with phones and electricity and anything else that requires credit. You have indirectly implied that you hope by coming to Canada it will all just go away. It doesn´t. I would strongly encourage you to find some way to restore your credit before leaving the US. Your life will be much simpler on both sides of the border.

sorry if my previous post sounded harsh. I find it very irritating to read posts from folks who think Canada is a great escape route for legal problems and financial problems. We had one poster who thought he could avoid prosecution for statutory rape in the US by claiming refuge status. Like I said before...Canada does not really want those kinds of problems- we have more than enough already.

Come and make a fresh start but make the dogs go away first. you will be much happier.

I have a friend who has a lot of unpaid debts, doesn´t have a job, living on student loan.. still she is using awfully lot of money to buy nonsense even though she can´t even pay her debts. Why should other people have to pay for these people in the form of increasing costs who use money they have not even earned. I have used credit cards but I always pay my bills even when I don´t have much money. I just don´t spend so much when I know I can not handle it.

Kat here is your last bet! You can leave to Canada without informing anyone where you went. However, you have to change the habit of borrowing! If you lie low in Canada, it is next to impossible to trace you. Lying-low means no more credit cards or quick debt. You can obtain a debit card (just avoid the middle name or such.... to throw em off). Often, it is the habit that is a prob. I know one guy who defaulted over 10 grand to electrnoci shops and then he walked into a Bestbuy Canada and showed a Canadian Card! Once they spotted him, they brought the suit. It took them a lot of time but he never suspected... so stayed on and got caught.

your 2 posts on this subject suggest you have some serious problems on your hands. There are agencies in the US and Canada that help people sort out their financial problems and help people make suitable repayment arrangements with creditors. Some of the ideas you are contemplating will make a bad situation even worse for yourself. I would urge you to look at some alternatives that will get you out from under your situation that will not have potential problems attached to them. Good luck.
