Subject: Roy and Experts I need your help
  My PR is about to expire in 2 months and I haven´t fulfilled the obligatory 2 year out of the past 5 years. I returned 8 months back to Canada and only 2 months are remaining before my pr expires. On my return from US at the border I told the truth that due to my personal reasons I could not return earlier but now I have all the intention to go back and make it a permanent residency. The officer said I clearly violated the pr status and said it will be a problem when I go for the next PR renewal but somehow convinced and let me in to Canada. She did not make any entry in to the system and she did not make a note of my stay.

I have been waiting to get a job so that I can proceed with the sponsorship of my wife and kids. Now I got the job and want to proceed with the sponsorship process.

Do I wait and get the PR renewed then apply for the sponsorship or shall I right away start the process. I checked with one immigration consultant and he said I don´t have to give the facts of my absence since there is no proof of any stamps otherwise I am straight away out of pr status and my application will be rejected, it means I have to lie in the application and I dont want to do that. But I want to go with the correct dates and state the truth. What are the implications. I am very worried and getting nervous. Please give me your expert advise.

Lying won´t help you even if you don´t have entry/exit stamps because you don´t have proofs for the residency you want to fabricate ( such as credit card transaction..etc).

I don´t know if there is any exemptions for the 2-year rule. I am afraid you have to re-apply for PR.

You cannot jump for your family sponsorship and you are already out of status.

Did you spend your time out of Canada with your Canadian wife? or working for a Canadian company abroad? If the answer is yes, there is a possibility there. If the answer is no, then CIC will start the process to revoke your PR status. You can appeal though.

You cannot apply for a PR at this time, for the simple reason that you are one as of today. Your PR status has not been rovoked yet. There is a process to do so, it doesn´t happen over night.

The card is a card and you are a PR unless they take that away from you. Now the part where the Officer said you violated and never entered any information is strange.

The PR card allows those from non visitor visa countries to get on a plane and return.

Is that not logical?

H&C factors are considered so what story you told at the POE could of made a difference.

Now sponsoring at this time could get you into a load of trouble since they have access to US tasx information.

DocD, I didn´t work for any canadian company nor my wife is a canadian.

Is there any solution to my problem other than starting over reapplying for a PR.

You can tell the truth and hope for the best.
If there are Humanitarian and Compassionate grounds and you are HONEST then the CIC Officer may give you a renewal without issue.
However no matter what your immigration lawyer told you about stamps etc... they are incorrect.
All the officers have to do is check their systems and they can see both when/where you left Canada and when/where you returned, doing the math they will be able to see that a minus b does not equal 730 days.

Just be truthful, and hope for the best.

I really need a help. I am currently a convention refugee, although I have applied for PR card which might be ready by April 2009. My long-term fiancé of 9 years is in South Africa illegal. I am planning to travel there to marry him, and then come to Canada with the documents and sponsor. My school is starting on January 4th, 2009 and my fiancé is pressurizing me to come because he missed me. It being 27 month I left him which I think and know it is not fair. My education is on the line, my future is also at stake because my fiancé is losing is patient. He waited for me to get my papers. Now that I have them I am planning to get education which is very important. I really need help. Is it possible to sponsor him? Since I am a student without job can I sponsor?
