Subject: better ? appl US or India on H-1 B for Canada PR ?
  Hi,

I am on H-4 and my husband on H-1. As my skills are on demand in CIC site..... I am planning to apply for Canada PR under Federal class ... It´s already 1 year since I came to USA...Chances are high that I will stay in USA for next 1 year as it seems processing time when one applies in US is 1 year.. but there is slight possibility that I might need to move to India before 1 year as well depending on husband´s employer´s needs....

Please let me know:

- what kind of problems I might face if I move to India in between of the immigration process ? Is address change from US to India in b/w process is common scenario ?

- If there are lot of issues in changing address specially countries, then shall I wait to apply when I go back to India....but the problem is that processing times are much much more from India......

- I have heard not sure that during later stages when police clearance and specially medical clearance is required... CIC will send documents to authroized medical officer in USA to get medical checks done and .if I won´t be physically present then CIC would send file to Delhi and process would be started from scratch.....and processing fees might also be lost .....is this true ?

Please suggest whoever has good info on this....?

App from the US is always faster and can take less than a year (mine took 9 months at Buffalo center to hear the approval and then it took around 4-6 months to finish the rest (submitting the medicals and getting the visa stamp on the passport). Therefore, if you won´t stay in the US for about 2 years from the date of application, you might have difficulties (might ask for interview, sending the passport from India for stamping at Buffalo center is not easy...etc).

Buffalo Center deals with US addresses only. Conducting the interview while you r in india and sending the passport for stamping from India are usually the biggest challeneges.

You can go ahead and submit from the US. Before you leave, ask someone to follow up. When any letter received, they can open it for you and tell you about it. When it comes for sending the passport, you send it to the person who follows up and Buffalo will return it to him/her. If interview is grant it, you have to come. It is risky but I know some people who did it and it worked. As long as you stayed in the States for one year, you are always eligible to apply from the US, even if you are leaving the States later.

CIC sends the medical forms to YOU, not for your doctor. You take the forms and do it with ANY DESIGNATED doctor, even in India. Once the person who follows up receives the forms on the US address, he/she sends them to you to India and you do the exams by any doctor there and send the results from India. For the police clearance, you to get the clearance before you leave. The clearance is usually sent initially with the package. Do it with the initial paperwork (transcripts, education and work exepriences, IELTS, and police clearance). ONLY the medical is asked to be done after the approval.

As far as the interview is concerning, you might be lucky that the CIC waives the interview as happened for me) and this will make things easier.

Few more queries:

- Not sure if processing times are much much more from India..but read some posts saying that now processing in 6-12 months in Delhi....Is this true ? then applying in India from here I think is safe....Else better to apply in Delhi because traveling to Delhi/India any time is far far easy rather than other way round because in case my US visa expires in future and Buffalo calls me for interview in US then it would be very difficult.

- - On this link http://www.cic.gc.ca/english/information/security/police-cert/intro.asp, it is mentioned that "The certificate must have been issued no more than three months before you submit your application."
and
on the document EG7, page 20, under Police Certificates instruction- it states that "When you submit the application to the visa office please ensure that your certificates were not issued more than three months before you submitted your application to the CIO" 3 month date is applicable from first application to CIO or to visa specific form later ? So we can start the police clearance 3 months before I apply to CIO. As I need police clearance from US and Inda, I would like to get this done asap to avoid any delays at later stage ?

- - Everyone has only one original copy of certificates and for some documents like reference letter/work , CIC needs original letter. For all documents except transcripts, police certificate and medical , all documents notarized copies should be fine. Is this right ?

- - The work experience as stated on CIC site are pretty exhaustive. e.g no company provides responsibilities/ hours worked in the work ex letter. Also no one keep business card of ex - employer who signs work ex letter, salary slips of last 2--3 employer , only for current employer one can arrange the same. My understanding after reading posts is from past employer whatever best we can collect we should do and write the explanation in the cover letter ?

Yes you are right but Buffalo can waive the interview, as happened to me. I really don´t know about India. My personal experience was with buffalo center only (got the approval within 9 months).

You are right. It should be issued within three months from the date of application. It doesn´t matter how long your application to be reviewed after that. For example, the immigration officer might review your application six months after submitting the application with the ceritifcate. This means the certificate is not valid at the time of the review but I think they care that it is issued within three months from the app date regardless when it is reviewed. However, they can ask for renewal. In my case, I updated the certificate without asking for its renewal it. I did that just as a precaution to avoid any delay for asking for the renewal.

The one from the States (at my time) was issued from the FBI. Now I think they change the rule to be issued from the local State police (check the new application). In either way, you need to have finger prints. For those who leave the States, they can contact the FBI from overseas and provide them with your address in India and they send it to you. The problem is always with the finger printing. The FBI requires specific way of finger printing, which people overseas do not know how to do it. Therefore, initiate the processing now and do more than one FINGER PRINTING. Retain one in case you want to renew the US certificate as you have to submit another finger prints..

The police certificate should be original. Transcript is original too but if you have only one original, send a notarized copy of it (i sent notarized copy and it worked). Send also the original of anything that can be easily issued (such as bank statements).

The work experiences, letters of reference (if any), copies of passport, birth certificates, visa status in the States,...etc should be notarized. Notarization from the States is very easy. So do them before you go to India. Just go to your bank branch and ask for the notary public and they will do it for FREE (just keep things arranged..the originals opposite to the copies so that you don´t annoy them by notarizing tens of papers!!). You can also check the notary publics in your area (google notary public and match it with your State or city). I notarized EVERYTHING by going to two different branches of my bank..lol (so that I don´t overwhelm one notary with all this crab) and all for free. When you come to Canada you will see how rediculous notarization is. They make it a big business and charge 20-50 dollars for each paper. When you go to India, I am sure you have to to do it in the court or in a lawyer office!!! So do it in the States! By the way, see my advice in the bottom.

It is better to have all the time covered. Try to go for the ex-employers. To make it convenient for them, prepare the template so that they just sign it and print it on their letterhead. If they have their own templates, just issue it.











US is much better than Canada on all the aspects. I missed the States a lot. Do your best to settle there. Make Canada as your second option after the States. Trust me!.

As getting notary done for one paper costs 5-10 $ in USA and in India it is far far cheaper when there are lots of paper to be notarized. Please let me know if one (Indian) applies in Buffalo from US itself, will the Buffalo office accepts if notarization is done from India ?

In my opinion, the notarization strengthens the credibility of your document and might expedite the processing. In the light of huge fraud in the immigrants application, CIC tries not to grant any approval for those who don´t deserve it. Therefore, they very suspicious. when the immigration officer reviews a notarized document, he/she would NOT be very suspcious about it and might not verify it saving more time toward completing the processing, in contrast to revieiwng non-notarized documents. This is just an opinion. I NOTARIZED EVRYTHING as I was doing it for free, as explained earlier.

I think they accept any notarization, as long as it is does right and bears all the necessary signatures and seals.

Hi Anonymous,

Yes I checked few months back with one reputed bank with whom I have a/c as well for some other purpose and they don´t told that they do notary free for only those customers who has taken loan or mortgage kind of relationship and won´t do for all bank account holders.

I understand your response that even if apply in Buffalo, notary from either USA or India will be acceptable. Only requirement they should be notarized as per guidelines.

Just pay attention to what Sharon said....the apps now go for Sydney in NS, not Buffalo, NY (as was the case during the time of my application)
