Subject: Divorce and re-marriage after granting PR status
  Hello

I obtained my Permanent Resident status in the end of 2007 through family class immigration (my ex wife was the sponsor). The relationship didn´t work after that and I haven´t become a Canadian citizen yet. I re-married the person who I would like to sponsor to come to Canada. Am I eligible to do this and is this going to affect my status in Canada once immigration finds out that I divorced my sponsor, and plus that I want to sponsor my new spouse on top of all?

your new spouse was also your old spouse (am I reading the words ´remarried´ correctly?)

yikes you better have a good story to tell that you did not marry wife #2 for the purposes of immigration - which they will automatically ask when you apply to sponsor.

and, I believe the undertaking must be finished before you can commence a sponsorship so it sounds like you have another year to wait.

If you have been legally divorced in Canada, and now have re-married to another spouse from a different country, YES, you are eligible to sponsor her. However, you better convince the immigration authorities that your second marriage will going to work and it is a genuine marriage...

No, your divorce and subsequently remarrying does not affect your citizenship . People get married and divorce due to many reasons and if yours was a logical one, then no one would have any problem with this...

Thank you for your answer.
As you said, people get married and divorce for many reasons, but how is likely that Immigration is going to determine those reasons and question me or my ex wife why we got divorced, and then maybe decide to revoke my permanent resident status?

Timing is everything!

EVERYTHING!

So you came to Canada and your marriage did not work. People view things with their own mind sets and experience. So what will Immigration determine about your previous relationship?

Immigration Officers see tens of thousands of what appear to be bogus marriages every year. They are on the look out for bogus marriages. Will yours look like a previous bogus sponsorship?

Let us talk about timing.

So how long after Landing did you separate?

Week - two and a half years?

So how long after Landing did you get the divorce?

Was it a joint divorce or contested by one or the other parties? Did someone admit to adultery?

Was their sufficient time of one year for the two of you to live separate and apart before filing for divorce?

Possibly was it one year and one week since Landing? No good.

Did you get the divorce in Canada since you were both residing here or did you get it in your home country?

IMMIGRATION WILL QUESTION REGARDING TIMING WHICH YOU MUST REPORT ON YOUR UNDERTAKING OF ASSISTANCE FORM IMM 1344 A

Now like others who say things that you want to hear.

"People get divorced for many reasons"

but if the timing looks questionable expect nothing to happen on your Sponsorship approval or Citizenship Application and that means CIC are looking at your application based on a (MOC) Marriage of Convenience.

I don´t think people realize how precarious family class applications can be. I must admit, in the early years of my immigration addiction I would have said ´simple as pie´. I now see that they are the most difficult because they are so prone to fraud and convenience.

I don´t quite understand how Ivan can think he has a easy case to prove. I don´t work for CIC but I have red flags everywhere (and I have mentioned several)

When a skilled worker is refused... he is refused and the family carries on together. Risk associated with refusal is nominal. it is also very straight forward - you qualify or your don´t. Tough luck but you will live.

With so much riding on a positive assessment in a family class application one would think using assistance would be worth considering. Even with what I know about immigration, I don´t think I would attempt a family class application on my own - especially when there has been a previous sponsorship, unaccompanying children, significant cultural or age differences etc. Using outside assistance is not a guarantee but a second pair of objective eyes from someone with appropriate expertise sure seems like logic to me.

Hello alltogether,

I´m interested, how fast its possible after recieving the Canadian permanent residence Visa to make a divorce from her husband without losing the Canadian permanent residence.

My friend has the oppinion, that she could arrive in Canada and divorce very shortly after and would keep her permanent residence Visa.
I dont think like this, however I have no idea of immigration rules and laws.

May be you can help me. Thank you VERY much!!!

hi just wanted to find out how it work to apply for my resindent permit after divorce? because my canadian citizen and i, thing did not work out,then we divorced! but we got marriage in my coutry Cote D´ivore! we used to leaving together in south africa when she come to from canada, during her hollydays! we got marriage in the december 2001 and got divorce later and the year 2006! for some reason that are explainable in here. so it is still possible for me to apply for resident permit? i would like to know more about this for me to come up with all the necessary documents the need to apply to the nearest hicommission. thanks from maxme dali! please do not mine my english spelling because iam a french spoken person!looking forward to hear from you very soon!

i realy constest this divorce because we got marriage back home my country, then she sent me a divorce documents from canada under a pressure for to sign! for me, if my wife bonita ann seri was realy meaning divorcing, she could have back for us to appear at the the cote d´ivore divorce court for me get all my divorce decrees. but now iam let with the marriage certificateand other documents! so where do i go from here! iam stuk iam not sure if i have to goet marriage again, still have find out if the divorce its really considerable ! from maxime dali!
