Subject: Refugee Claimant after Studying
  Hello All!

I found this forum through Google and I was just searching for some advice.

I am a Pakistani passport holder, but I have lived in Saudi Arabia all my life. I came to Canada in 2004 to study at Ryerson University. I completed my degree in June 2009. I am now on the 3-year off-campus Work Permit program.

Now, the rules in Saudi Arabia are kind of strict and it is not possible for me (as a male) to maintain my residency in Saudi Arabia due to my age (22). Therefore, very soon I will not be able to return to Saudi Arabia and can only really go to Pakistan.

However, I do not have a house or any real close family in Pakistan and so going there would be disastrous as I have NEVER lived there. Only visited a couple of times over the past few years (for weddings, etc.)

Now I understand I can get a job and work for a year and be eligible for PR under the CEC program. However, I am finding this increasingly difficult day-by-day. I am an Aerospace Engineering graduate and almost ALL the jobs in my field are military/government related. Thus, they require some level of clearance which I CANNOT get as a non-Canadian.

Keeping all this in mind, I felt it might be a better option for me to file for refugee status as going back to Pakistan (my ´home´ country) would seriously endanger my livelihood. Not to mention the current state of affairs of Pakistan!

Also, I am currently working as a Security Guard and that does not qualify as a Skilled Job. But this is all I could currently get! =(

Any kind of advice for my situation is welcome. I have legally lived here for over 5 years now and have settled in and call it home

Visiting for weddings in Pakistan is substantial proof that you have relatives who do care for your presence there and your trips to Pakistan indicate you are familiar with the country and hence you can safely return there and establish a career for yourself. I don´t see any ground for refugee or any other claim.

Never lived in Pakistan but you wish to make a refugee claim against Pakistan, so what has been the change in circumstances since you left Pakistan that affects you personally? LOL LOL

You have to be internet savvy and do not know about CEC class.

@ misery: Thing is, the wedding was held in Pakistan because my sister was getting married to a guy whose family is there. I personally do not have any immediate family there. Also, my sister and her husband do not reside there, they are in the UK.

@Roy. Its clear that you are as ignorant as you are illiterate. It´s ironic you question my academics when yours are clearly in doubt. LOL LOL" >>> If you READ my original post I mentioned "but I have lived in Saudi Arabia all my life"... IE I HAVE NEVER LIVED IN PAKISTAN.

Lastly, you mentioned "You have to be internet savvy and do not know about CEC class." Once again if you READ MY ORIGINAL POST, I wrote: "Now I understand I can get a job and work for a year and be eligible for PR under the CEC program. " THEREFORE I DO KNOW ABOUT THE CEC PROGRAM.

I was only looking into this as a possible option. Next time you´re going to give useless advice I suggest you don´t. Instead find a hold and cry about your sorry existence. I don´t even know how you have anything to do with www.cvimmigration.com

Dear Zeus,

My sincere advice to you is not to even consider applying for your refugee claim. From the info you have provided, (also per misery) there seem to be no credible basis for your refugee claim which will most likely be refused and you might not have the right of appeal as well.

My suggestion to you would be to continue working as Security Officer and gain more experience to achieve one of the following positions:

supervisor, security guards
supervisor, parking lot
supervisor, shift route

All of the above falls under SKILL LEVEL B (major group NOC 6216) which is eligible under CEC category. Once, you are landed you know what to do....

You the Pakistani citizen who has never really lived in Pakistan is considering to make a refugee claim against the only country of which your a citizen, PAKISTAN. LOL

You never made a refugee claim against Pakistan during all the years you lived in Saudi Arabia!
WHY NOT?

You never made a refugee claim against Pakistan when you arrived safely in Canada in 2004.
WHY NOT?

You never made a refugee claim against Pakistan since 2004 (SIX YEARS) when you were granted Temporary Status as a Student in Canada!
WHY NOT?

You do not claim to have any changes in circumstances that would warrant a refugee claim since your departure from Pakistan.

You CLAIM you were educated at Ryerson University in Toronto so your English ability can not be an issue.

Considering such a spurious refugee claim is a disgusting action that would affect any person in the world in need of Canada´s refugee protection!

Considering or making such a spurious refugee claim could prevent someone in need of protection from obtaining same from the IRB.

Making such a spurious refugee claim affects every Canadian tax payer who covers the expenses of Canada´s Refugee Board.

Firstly, thank you all for the advice you gave me. I´m happy all of you (with the exception of Roy) understand that by getting a university education I do not become an expert on Canadian Immigration laws... lol That is the reason I came here, for advice. But for some reason this Roy character expected me to how the Canadian Refugee Protection program worked...

@ Roy: The main reason why I THOUGHT a refugee claim was valid was: My whole life I have lived safely in Saudi Arabia. Why would I make a claim in 2004 when I could go back to Saudi Arabia?? Once again you need to read my original post. THIS YEAR, I BECAME 22. I AM INELIGIBLE TO GO BACK TO SAUDI ARABIA AS OF APRIL 2010.

I DID NOT NEED TO. I WAS 17 AND I COULD RETURN TO SAUDI ARABIA ANYTIME = A SAFE PLACE FOR ME TO GO TO.

ONCE AGAIN, DIDN´T NEED TO AS I HAD SAUDI ARABIA AS A SAFE PLACE TO GO TO.

NOW, that option is not possible. If I were to leave Canada after my work permit expires, I can only go to Pakistan. THAT is what is bothering me. I of course know that I have 3 years and under the CEC I should be eligible once I get the appropriate work experience. However, I am just exploring my options early on.

So please Roy, I hope you´re not a licensed Canadian immigration person, because you do not deserve it.

how long have you known you would be turning 22?

April 2010 has not occured yet so you still have time to go back to your family in SA

The assumption that Refugee Claims can be used for anything that does not fit in the CIC regular application process is extremely distructive to those that need it for legitimate reasons.

You are wrong, you know you are wrong yet you try to say others should care if you are returned to Pakistan.

Well Zeus you even considering risking others lives in my opinion makes you unsuitable to reside in Canada.

I am not planning on abusing the system. I am genuinely concerned for my safety if I had to go back to Pakistan. I don´t think in my life I have ever been there for more than a stretch of 5 days and being there alone would be a nightmare. I just wanted to know if my case applied or not under the Refugee program, and it doesn´t.

Oh and btw, being the ex-President of the largest student unions in Ontario. I´ve made sure to send out your firms information to be forwarded to all international students. I´ve told them to stay away. Its apparent your mother did not hug you enough as a child as you would have given me a more civil answer the first time around.

a nightmare (read - don´t like the standard of living) is not the basis for a refugee claim. Like I said - you have until April 2010 to return to SA - get packing and apply from there as a skilled worker or CEC class.

ex president of a student union... Roy, are you scared? LOL
