Subject: divorce after 1 year of landing
  I am a PR and i am the principal applicant me and my wife came on Feb 09 and sadly we are having some problems and we are thinking on getting divorce we got married on dic 20 2003 and i just notice she left me so i would like to know what is the possibility of me getting a divorce and not loosing the PR status in this country ?? and also since i was married in india i will have to get divorce there ?? and if this happens i will be able to sponsor in the future??

Honesty will get you very far indeed; since your troubles began AFTER arriving here and you have been married to your spouse for a number of years prior to landing, it all appears genuine. If it is genuine marriage that went south (they do go south in many cases), just get the divorce in Canada first and separate your PR existence, so to say; If you are principal applicant, you maybe on the hook for the spouse if he/she goes to public assistance (welfare monies). Otherwise, there shouldn´t be any prob. Getting divorce in India should not be a question.... Canadian divorce is fully recognized in Indian courts so that part should be easy. Out of curiosity, is it a myth that the Indian folks work out problems and are likely to have lasting marriages? Why is the divorce rate so low in India compared to Indians in Canada?????

You should know better!

The Canadian Divorce Act requires that partners must divorce in the location they normally reside.

If both parties reside in Canada, they have to divorce here. Anyone who comes to Canada then flies home to quickly get a divorce and sponsor someone will be investigated by CBSA until the cows walk down Yonge Street.

Scenario
Oh wife, we need money and Ms. ______ Parents will pay $35,000.00 for a bogus marriage application, darling that is better odds then 6/49 so lets divorce. Honey it is only a piece of paper! WRONG!

If your in a real marriage and it is beyond repair, divorce.

Then when you get remarried and sponsor a new wife expect Immigration to force an interview and ask questions why you the sponsor raced back into wedlock.

It will not be a walk in the park.

Hi there,
I have been married to my husband for almost 3 years. He went back home and was granted to return in July of 2014.I filed for him thinking we were in love, I recently found out that he has been having an affair for over 6 months and I find it very difficult to forgive him. If I file for a divorce will he be sent back home? We have a 2 year old son and I have a 14 year old son from a previous relationship, I truly believe that he married me to get his PR card. I no longer see any future with this man.
Please advise!
