Subject: getting married
  I am planning to marry my girl friend, she is american ia am canadian.Does it make more sense to get married in the us or canada, and what is the waiting time before she gets medical coverage and will be able to take on a full time job. Someone please help me its so frustrating all we want to do is start a life together.

You are likely to get work permit faster in the US than Canada. I don´t think Canada has the so called temporary green card.

if you are a Canadaian, your provincial medical plan should cover your sponsors too

Note: Given that I´m immigrating to Ontario, all information I give is for the province of Ontario...the other provinces may vary.

My best suggestion is for you to get married in the U.S. The main reason for this is because it is far quicker to get your official marriage certificate in the U.S then it is in Canada. In the province of Ontario, it takes the province 34 weeks to register a marriage after it is performed, once the marriage is registered THEN and only then can you apply for a marriage certificate, after you apply for the certificate it takes 6-8 weeks to receive it (unless you are able to get it expedited, in that case it only takes 2 weeks).

I´m going to assume that she is looking at immigrating to Canada, based on your question of when she will be eligible for medical coverage and able to get a full-time job.

The answer to that depends on how she applies for permanent residence. If she enters Canada and receives a visitor´s record/visa upon entry and then proceeds to apply for permanent residence via spousal sponsorship from within Canada, in the province of Ontario she will be eligible to apply for provincial medical coverage once she receives Approval in Principle. Approval in Principle is usually received within 5-6 months of when the completed application is received by CIC. Her medical coverage would become active 3 months after that. Once Approval in Principle is received she is also be eligible to apply for an open work permit which would allow her to get a job anywhere without needing approval from HRDC. FYI - after approval in principle is received, it could take anywhere from a month to over a year for her to get her permanent residence, she would need to keep her status in Canada valid until PR is received because if she doesn´t she would no longer be considered eligible under the "In-Canada" class.

Her other option would be to apply "outside" of Canada. Assuming she enters Canada on a visitor´s record/visa, this option would still be open to her, so she would be able to remain with you while her application is in process. With outside applications, she would not be eligible for medical coverage or able to work until after she becomes an official "landed" immigrant. Medical coverage becomes active 3 months after landing, she would just have to apply for it sometime within those first three months after landing. She would be able to start working within a month or so of landing. She would just need to apply for a Social Insurance Number, which once applied for takes roughly 4-6 weeks to receive. Given that she´s American, her application would be handled by the visa office in Buffalo, NY once you are approved for sponsorship by the processing centre in Mississauga. From what I´ve heard, on average spousal sponsorship PR applications are processed by Buffalo within 9 months. The actual time can be shorter or longer depending on the individual application.

For example, my application from when it was received by the processing centre in Mississauga to when I received my passport request from Buffalo took just under 6 months. It was received by Mississauga on July 6th, my husband was approved as my sponsor on August 6th & my PR application forwarded to Buffalo, Buffalo began processing my application on October 5th, December 20th the Buffalo RPC sent out my passport request letter.

Oops, I forgot to mention. I´m American, my husband is Canadian. We were married in October 2003 in Ontario. I officially entered Canada in January 2004, I was issued a visitor´s record when I crossed the border with my husband.

what happens if the two of spouses divorce after 1st stage approval?
Will it affect him or her getting a PR status?
