Subject: H & C application and PRRA combined
  the situation is that my family had entered Canada in 2003 as refugee claimants and had lived in the usa for 10 years with a pending asylum that was denied and went for appeal. My parents decided to come to Canada and at the time I was 14 years old. I left my nation at the age of 6 and now I am 22 years old. Our refugee claim was refused and we filed for an H & C application as well as PRRA in 2006. My two sisters have sponsored or did undertaking for my parents as they are PR card holders. I have 10 canadian citizen nieces and nephews. I come from a large family and the situation is quite dire. Since my parents and older siblings suffered from depression after coming into Canada and did not work towards establishing themselves. However, my older brotehr and I are currently working at the same place for over 3 three years while getting recognition, awards and promotions at work. I graduated from Canadian High School but was unable to go to school as I can not afford the international fees.I did recently started to volunteering but due to terrible turn of events could not keep the commitment. my younger brother got into a serious car accident last month where he needs critical medical attention. We are worried because we received a letter asking for updates and stating that they have combined our prra and H & C together. I don´t know if its a good sign and with my brothers health its getting hard to be hopeful? I havent seen my country in over 15 years. my little brother came to north america at the age of 1 1/2 years of age and is now 17. Does anyone know if having the H&C and PRRA combined is a good thing? and if this has happened to someone before? Are our chances good?

No it is not a good thing to combine anything when it comes to a decision maker who will have to wear two hats at the same time.

So they have depression who cares, not CBSA! Deppresion will not prevent them from flying home. Focus on the IP5 Manual and interpret what is an unusual, undeserved or disproportionate hardship.

Get to work focusing on the solution.

Thanks Roy. But we are fairly established now considering that the annual household income is over $80,000. We do pay taxes and all. Do you think we have a fair chance in the H&C at all? If the PRRA isn´t as strong. The lawyers say the case is great but i don´t trust them my parents have been screwed over multiple times by lawyers. My brother and I are handling the case now but the PRRA part doesn´t seem as strong since it has been over 15 years. Will they evaluate both the criterias with significance even if one is stronger than the other.

You have a Lawyer and therefor Legal advisory person.

Less than 1% of PRRA´s are successful and parents and older siblings never worked in Canada so they deserve compassion for........?

I´m sorry but there is nothing in this posting that would want me to show compassion.

I am different I just can not tell clients that they have a great chance when there is no evidence to support the statement.

Maybe there is something else that I do not know about that Legal Counsel sees but it is not in your posting.

I would have done an overseas parental sponsorship years ago. 10 years in the states would have been plenty of time to get them here.

I think there is a miscommunication. My parents and older siblings have been working. The older siblings are married now and have children. Originally when they had entered in Canada they were not working but that was about 4 or 5 years ago. But now they are separated from my parents. The only children left on the file are my two brothers and I who came as minors. My father is working so am I and my brother as well. We give charity and donations, etc. And volunteer on occassion. My immediate family pretty much resides in Canada. But because the PRRA and H & C are together I´m just worried if that could have a negative impact. sorry about the confusion.

I don´t think you get the point here.

Charity, siblins, paying taxes MEANS NOTHING!!!!!!You have to focus on what is an unusual, undeserved or disproportionate hardship if they were to return to their home land and being depressed is NOT ONE OF THEM. WHO CARES!

10 Years in the US? why didn´t you fill the application before? Do you think that the fact that they were already denied in the US will sit well @ CIC?
Do you think that CIC will not question that? They will need to find out what were the reasons of the previous refusal and trust me, a lot of that criteria will be used to assess your current situation.

Unless they can prove that returning to their home country is a risk for their lives since the day they sent the application until today, all of you have a foot on the plane already.

Keep one more thing in mind.
Lawyers, ARE NOT professionally trained to deal with immigration manners. For the most part those are the easiest to eat alive in a hearing. Check their references in similar cases.

I win H&C cases all the time and can prove same. What DocD is mainly referring to is your Pre Removal Risk Assessment application and unfortunately he is basically right.

To a large extent what was claimed in the States regarding the reason for a refugee claim and what was the reason for the refugee claim here would of been compared. Any inconsistencies between the two would of been highlighted.

Now H&C is different this is all good and can be expanded on, "My father is working so am I and my brother as well. We give charity and donations, etc. And volunteer on occassion. My immediate family pretty much resides in Canada".

Cross your fingers and hope for the best.

Hi am prra applicant who´s refugee hearing was abandoned due to misrepresentation. I hve a 1yr old canadian born daughter am married to a PR I hve been the main provider frm the strt of our over 2yr relation ship. I filed the my prra and sponsorship application 2gether in feb of 2012 and 2 months later I receive a letter saying that a decision has been made and i need to come in for an interview. can anyone give me the possibilities of the outcome.plse. I also believe if I am to leave my wife will be forced to go on welfare.
