Subject: Husband Removed - Leaves behind Canadian kids
  We find we are in a holding pattern and our financial situation is getting beyond desperate. Just wondering if there is anything I can do to "hurry up" this process.

FACTS:

My husband and I have been married for almost 20 yrs. I am a Canadian citizen - our two young children are also Canadian citizens. My husband left El Salvador at the age of 16 - he is now almost 40yrs old. Originally came in as a Refugee claimant - was denied - is currently being processed externally (spousal application) - he was removed from Canada (he voluntarily bought the ticket and left) almost a year ago. He is unable to find employment in El Salvador, he is not fluent in Spanish any longer as he had not spoken it in 23 yrs. His application was approved in Missisauga and received in Guatemala City in November. I cannot reach a human being there by phone or email. I have filled out the standard form and emailed three times - no response. My MP has tried to reach them and their answer is one of those rote responses - "it is being processsed". For the sake of reunification I would have thought this process would have been a bit faster. Our kids have not seen their Dad in almost a year now. I have an Admin Asst position, therefore, do not earn lots of money. I am having to support him and starting to lose everything as a result. Is there anything that I can do to hurry up this process before I lose everything? Thanks.

why did you wait 20 years to sponsor him? Inland sponsorship would have taken 2 years... outland 1 year.

I have a lot of compassion in me but this seems a little rediculous. You had a lot of opportunities to avoid this drama.

The file has been in Guatemala since November. CIC website says 8-21 months. You are at 2.

We didn´t wait 20 yrs to sponsor - we did our first spousal application in 1992 - it was denied due to a public mischief charge he had at age 18 - his file was lost - it is a long story - we had him on a ministers permit and work permits renewed every year - in fact we opened a business employing 5 Canadians - which we then had to sell when it became apparent he was going to be removed - every lawyer that has looked at our case has said that the "left hand of Immigration didn´t know what the right hand was doing" - the current spousal application was apparently being processed in Mississauga and when he was instructed to sign the Removal order they assured us over and over that "nothing will happen to this removal order, it is just a formality" and in the meantime they would process our spousal application yet again, a week later they sent letter to start the removal process - they don´t mind keep taking our money though - they are good at that - too many dramas to go into on this forum, but believe me we were always on top of Immigration to get him sorted out.

I am aware of the time periods posted on the Immigration website. I am also aware of the phone number, fax and email address of Guatemala office - I email and phone all the time for updates, my MP tries to get updates as well. I am just wondering if anyone out there is aware of a way to speed the process up or get in touch with someone in person If flying down to the office in Guatemala to speak with a human being would speed it up, then I will do that. Just wondering if there was something I can do. Sitting around waiting and watching my kids grow up without him is just not ideal, especially since he is sitting in a country where he has no family or friends whatsoever and no employment - it is a very difficult life down there. You bother them all the time, what is happening with my file, what is happening with my file, etc. and you will upset them. I just got an ARC for a Lady with two Canadian born children from Beijing China. It took her more than a year the fastest was two and a half months.

Keep bugging them and with them taking the file out and putting it back in his file could have things drop out of it.

The Visa Post staff don´t care.

THINK BIG, the average Canadian will care if the story can be told properly.

1- The MP cannot do anything about speeding up your application. That is a huge misconception about the "where the MP´s authority ends and where the CBSA/CIC juridiction begins".

2- The only thing that would help is if all the documentation was properly filled, the RCMP record was attached to the application and all the fees are paid.
Was he given an exclusion order (yellow form) or a blue form that reads "Volunteer departure order" and has his picture in the top right corner?

If the first one was given he needs and ARC if the second one was given, there is a high possibility that CIC will call him for an interview when they are in the final stage to finalize his application.
