Subject: proof of genuine marriage |

Hi. I´d like some advice and your opinions.
I´m a white woman who was born in Canada. My husband is Nigerian. We met and started dating in 2001 (in a third country where we both were working)and got married in 2007. His application for permanent residence was rejected and we are appealing. The visa officer said that she didn´t believe our marriage was genuine.
We have never lived together. We dated from 2001 to 2005, then we went back to our respective countries. I´ve been to Nigeria three times to visit him, and we also traveled together in West Africa.
I have phone records from 2005 to the present (my phone records; he used phone cards), a few emails, parcel receipts, one receipt from money I sent him, proof of travel, letters from friends saying they believe he loves me, our marriage certificate, photos.
I am ten years older than he is and more educated. I have letters and other proof from both families that this is normal in our families. (For example, my sister is married to a guy 15 years younger than she is, my mom is older than my dad, ten of his relatives are in marriages where the wife´s education is significantly better than the husband´s.)
I thought this would be enough proof, but he was rejected. What else can I show them?

Chavez vs MCI this Federal Court case explains in detail what is required to prove a genuine marriage at appeal.
Submitted a DIY spousal application and now filing an appeal by DIY. Strange!
I assume it was only regulation 4 refusal. PRAY FOR A ADR. There is considerable information regarding appeals on my updated web site.
