Subject: Spouse Sponsorship.
  Hi,
I sposered my husband, who hold the passport of different country but he wokrs in US for more than 3 yrs on work permit. We got married last year in US and I was living with him then I filled 3 months back his immigration through one of the community service immigration who does for free. I didnt attached his Medical yet. So, I am wondering how long will it take him to come here.
Is there any way he can apply for work permit on the ground of spouse sponsorship. He is working as a IT Project Manager in Siemens, US.
Does his process will go to his country or US as he is in US and how long will it take more? Any idea.

Thanks

Hi - I am Canadian and I am married for 9 years with a German and live in his country since then. However, unfortunately he lost his job and our financial situation is not good anymore - besides that, he got 2 strokes in 4 years and because of this he cannot walk normally anymore. And here in Germany, people are very prejudice with regard to handicapped people and they dont give them any job, so we have to live on welfare, what is terrible. -- So we decided that the best would be for us to go to Canada and live there in my country, in Calgary, where I was born. However, as he needs always medical treatment and permanent medicine - we were adviced to hire an immigration lawyer and start a process to get his permanet resident visa for Canada. But because of his medical history, I was told that my husband cannot live permanently in Canada, also because I dont have the financial means to support him. He only can stay for 6 months in Canada and then leave for another 6 months and stay in his country and so on. - I dont like to stay in Germany and would like to go back to my country for better opportunities; but I cannot nor do I want to leave my husband especially now that he needs me most. Besides this, we love each other very much. Please... Does anyone know what should I do? - Looking forward for your answer. Thank you.

First of all I respect you very much what you are doing for your husband.
I would recommend that you call the immigration guys and ask over the phone or hire a lawyer. No one can separate from your husband if you want to come back to canada you husband will also move with you. The only things is the process. Ask the immigration lawyer about that. Hope you can settle down in Canada.

Thank you so much (MOBI) for your reply! I do appreciate very much. Unfortunately my situation is very complicated, as the "Canadian Government" have changed some laws, wich make things very difficult, especially in my case. I have contact and hired an immigration lawyer, and nothing good came out of this, but only money we spent. As they see my husband as a sick person and he will not bring any profit for Canada, then "they" have no interest to give him a permanent resident visa. So, as I have said previously, my husband can go to Canada, but he will never get his permanent visa, as he can stay only for 6 months and come back to Germany for another 6 months. - Here in Germany if a German citzen wants to get married to a person from another country, and has no job, his/her spouse will never get a permanent visa. Besides that, the immigration dept will do anything to make this marriage impossible to be accomplished. And in case of death of German citzen - the foreign spouse "MUST" go back to his/her country. - This is crazy. -- :-(

Hi Bash, - thank you so much for answering to my msg. No, I am currently "still" (unfortunately) living in Germany. -- Yes, I have got a refusal letter from the Canadian Embassador of Canada in Berlin, trhough our Immigration lawyer in Toronto, who was working in the process for more than 3 years to get my husband a skilled worker visa, and this happened 1 day before Xmas. So, you can imagine how it was our Xmas and New Year Eve! - We´ve tried anything we could, to find a job over there but needless to say that we were not successful. - Anyway... we still keep very positive and who knows maybe someone would like to sponsor us with a job... Hope... Faith...

Hi Just me,

Did you get the refusal leetter for your husband´s skilled worker application or your spousal sponsorship application?

Also, what were the reasons for refusal?

Question (in reply to: Spouse Sponsorship.)
HI
I have received a refusal letter from Visa office in Turkey regarding to my application to sponsor my wife who lives in Iran. This is my second marriage. my ex and I had separated on december 2008 and legal process to obtain divorce certificate started on the same date. However, based on my wrong perception, I thought it would be legal if I marry again before I received Divorce certificate. I went back Iran and got married on 10/10/2010. few month later I obtained a divorce certificate from both Iranian and Canadian court and submitted them to the visa office. They have rejected my wife´s permeant resident application based on the ground that I was in another relationship when we married and my wife would not be considered as a member of my family class.
My point is first of all I did not aware of that I had to have divorce certificate before marriage. secondly I was honest with immigration in providing all information about my previous and current relationship. Plus, I have traveled to Iran 3 times spending 6 month over there with my wife. My question is, how much chance I have to convince the appeal panel to change the decision and what other option do I have. Does legal Aid provided for these matters in BC?
It is extremely painful situation for me and I cannot even think rationally and find a appropriate way to deal with that. I appreciate it if you can assist me.
Thank you
Rezgar
