Subject: Application Withdrawl
  I am Canadian PR, my fiance visited me here and we decided to get civil marriage done here. After that she went back and i have applied her PR. But she got refused because they think our marriage isn´t genuine saying that you haven´t done religious marriage.
Now my option is to appeal or not.
As i am thinking to withdraw my application, go back to my home country and get married properly (religious)and the re-apply again.
I really want to know is it OK to proceed like this?? Or to appeal??

in my opinion, it is faster and cheaper to withdrawl and start again. That way you still have your appeal option in your back pocket.

Your post makes little if any sense!

If you were married in a civil ceremony your married. PERIOD!

Now if you did the application yourself and did not prove your relationship they will refuse you for regulation four.

Now you did say your girlfriend, so did any of her family or friends attend her first marriage?

If you do not appeal and start over the Visa Post will send her for an interview and refuse again unless there are major changes to the previous application then you will have to appeal anyways.

60% win at the Alternate Dispute Resolution stage in Toronto. You should hire someone with experience that can provide references or prove on paper they win spousal appeals.

Thanks for your replies...
My fiance was just visiting me, we just did court marriage. It was just simple get together.None of her family member attend this marriage. So in interview IO asked about marriage in India (i.e religious marriage), also coz of work i didn´t go to meet her in-between. we were well short of proofs i guess. Main objections are there wasn´t any religious marriage, she didn´t stay with my mother when she was in India,I didn´t go to meet her.
So anyways to prove them we are genuine couple, we have to do religious marriage in India and provide them full proofs. But our marriage is going to be in SEP 2010.
So that´s why i don´t want to go through ADR. Please advice.

Court Marriage dah that is an unusual term. Civil Marriage.

WEB CAM Photos are plenty of proof and they can be staged but you had no proof??????????????

Think about it you were jumping to the front of the line that takes two months to process 30% OF THAT VISA POST APPLICATIONS AND YOU WANT EVERYONE HERE TO BELIEVE YOU????

You flew her here instead of you going there where your Mother lives.

So lets get this straight YOU SCREWED UP (DIY) and you want to wait another 6 months to sleep under the same roof as your wife and to wake up in her arms as Husband and Wife.

THEN YOUR GOING TO APPLY AGAIN!!!!!!!

DAH.............

Now you do not want to go through an ADR process and PROVE your marriage to be with your wife for EVER in six months.

You want to not appeal, and start over with no new evidence other then a ceremony that proves nothing, (you can´t even live with her) (touch her)for a week after your marriage (official ceremony). She can not move into your house for a WEEK!!!!!

TRY AGAIN to convince us!
