Subject: please help me with my question!
  hi I have a question. I am canadian citizen sponsoring my spouse who is of another country origin. We both live in the states for more than 4 years now but I want to return to Canada and therefore am sponsoring him under family sponsorship. Can anyone help me figure out which office needs to process his application? Is it Buffalo or his home country? I dont understand why they ask that in the application shouldn´t they take care of this?

Hi Oana,

When you are applying for your spouse, you have to send the application to Mississauga, refer to below mentioned link.

http://www.cic.gc.ca/english/information/applications/fc.asp

Then from there you will get approval or denial letter for your application. Once you receive the approval letter you can ask your spouse to send the application to the Buffalo, NY office as he has been residing in USA from last 4 years. Its a low that you can apply from the country you are residing currently if you are in that country on a legal status from last one year. But keep in mind that your spouse has to provide Police Clearance Certificate from USA as well as the country of origin.

hi,

you have to send your application to Mississauga first and Missisauga will send it to his home country thats what they did to my application...

call the canadian embassy and ask them they know better then me:

Oana,

You submit one joint package to the case processing centre in Mississauga,ON. They will transfer the application to the visa office which will eventually issue the immigrant visa (or refuse the application).

You have to choose the processing visa office since the applicant may be eligible to processing at more than one visa office pursuant to section 11 of the immigration and refugee protection regulations.They allow the applicant to make that determination because it doesn´t make sense for them to dictate that. Keep in mind you have to choose wisely cause file transfers are at the discretion of CIC and are done for program integrity reasons only.
