Subject: Sharon - pls. advice !
  Dear Sharon,
Need your advice pls. I had an HRDC approved job offer when I filed my case for PR in Nov. 03. Didnt wanna go on work permit for some time & thought the process takes 6 months from London at the most. But its been over a year now & nothing has changed yet. My query is that if I had approved job offer that time, would I get the points under arranged employment category at the time of interview or would CIC like to see any current job offer coz its been a long while & employer didnt wait for me. Please advice coz its giving me headache. Thanks in advance.

I really do not understand how this arranged employment works. You really cannot blame an employer for not wanting to wait almost a year to fill a position. I would have thought your application would have been fast-tracked.

I am afraid I have no good answer for you.

My purpose of asking your advice is - would I get the points under arranged employment as I had it at the time of submission ? Or they only want the people who get approved job offer once the interview has been arranged. I am in doubt. Pls. clear the situation.

I really do not know the answer. Have you tried calling CIC? or an immigration consultant. sometimes they will give you a quick answer for free.

I know your Question is not to me but would like to answer it. When you applied initially with this HRDC job offer, you got credit points for that. Now when they are going to do an IA, they will ask for proof of it. This means that you have to show that you still have the job. Which you don´t have. So you lose points for it. What CIC expects is that when applicants get HRDC approved job, they should take it and show it as current employer at the time of IA. Otherwise, getting a HRDC approved job offer from XYZ Inc. would turn into a business opportunity for immigration agents.

your answer sounds absolutely reasonable. So if that be true, what is the point of arranging employment when it takes so long to actually arrive and start working? How can anyone fufill that kind of job arrangement? It baffles me

Getting a work visa against a HRDC approved job offer is not a tedious job. It takes only 1 month after Canadian consulate gets confirmation docs from HRDC. Most of the PR applicants who get HRDC approved job offers don´t intend to go to Canada and work. This is all for a reason coz they are either working in a good position and making good money or considering Canada just as a second option in case they are kicked off from their jobs in US or elsewhere.

Ok... I am trying to understand. Please excuse my stupidity. So, Sandy has made efforts to secure a job and get points on his/her application for skilled worker. Given the outrageously long processing time, why do they have that point allocation at all! Does any employer other than a family run business employing cousin Eddy intend to wait a year + for an employee (none I know of and none that would qualify for HRDC approval) Does an applicant have any hope in hell of accessing those points by the time an interview rolls around? It seems outrageous.

Ok I have a plausible answer. Is that arranged employment designed for those currently in Canada on a work permit? they are working and applying for PR from within Canada. Therefore, as long as they continue to be in Canada, under their work permit until PR completed the points would count? Wow... how many applicants does that cover... 10?

I am happy to see you debating on my behalf. Now, I think I should fax to CIC & ask them for the reply, whats your opinion ? I totally agree with you that if someone had approved job offer at the time of submission, he is eligible to get points for it. But wondering is, a lot many people must have applied under same situation as mine but nobody has come forward to share this bit of information. Thanks anyway, will keep you informed.

As far as I am aware you need to have that job offer valid throughout your application process. If you get HRDC validated job offer, you can apply for employment authorization. In order to get points for arranged employment you have to have that arranged employment. Not just in paper in the beginning...I did not get points for arranged employment in the past, even when I was working in Canada, because my employment authorization expired before CIC decision. Had I applied earlier (right after beginning of my job) I would have most likely been granted those points.
