  So this is a little bit of an odd situation, but I´d like to stress that it´s not my own, I´m simply asking for someone else, who although their situation STARTED like mine (falling in love with an american over the internet), we both took different routes (I went through CIC and am still waiting). He on the other hand, had his girlfriend fly from the US with her 14 year old autistic child. They lived with him for the summer, at which point in september the boy was registered for school in ontario (I found it odd that they did not ask for the childs education records or PR card or anything, since technically at that point he was still a "visitor" within his 6 month limit). They currently have his income (not enough to meet the minimum to support her and the child, assuming he plans to actually marry her, which he doesn´t seem to want to) as well as her income, which is from some sort of accident insurance, she gets a monthly income. So I was chatting with him over the weekend and casually asked him how things were going. He said great, the child is in school and they are soon planning to go to the US, get her passport stamped and then return to canada. So I ask him how long she´s been here, he replies "only 10 months". So i mentioned the 6 month rule to him and he had NO clue about it.

So really what i´m asking is if he should have her return home to TRY and get it stamped again? Would it even be possible to marry her and do an in-canada application (since from what i understand she´s here illegally, isn´t she?). And will he be liable for the education that the child has been enrolled in? Really, any advice you could give me for him would be appreciated (even if it´s bad news, it´s better to know).

This is what is going to happen.

1- She goes back to the US
2- She is going to try to re-enter Canada and guess what is going to happen at the port of entry?

She will be refused of entry!. That simple. She overstayed her permit, she enrolled a minor in school which clearly shows that she is not a turist and so on and on.

He cannot sponsor her at this point. They don´t qualify as a common law yet and they are not married.

What if they wait out the rest of the 12 months to be common law, or go and get married (I think at this point he´s willing to do either one if it means he can sponsor her).
