Subject: Employment Insurance Problem
  Hello, received Notice Of Dept an Overpayment i need to pay, from Human Resources and Social Development Canada (employment Insurance).
I havenot paid the amount and am filing my Tax Return, i know it will show up the Dept in my option C, my Question is will CIC refuse my application for sponsorship of my spouse ???, should i just not file my tax return since i live and work abroad, telling CIC i donot have option C ???

I urge you to repay EI as soon as possible. Were you out of the country and collecting Canadian EI at the same time? People try it all the time - more often than not they get caught. Are you a citizen or a PR? If you are a PR you may be dancing with misrepresentation so get it paid back - fast.

NEVER lie to CIC. it will bite you in the ass.

Thanks Sharon, i am canadian citizen, i did collect EI for 8 month when living in Canada years back, i have been outside canada for about 3 years and never collect EI when i left Canada but did receive a letter at my mailbox in Canada a year later when i left Canada with an overpayment of my EI, i am not there in canada to prove they are at fault so i just ignored EI dept for two years and now i donot know what to do, i never broke the law and cannot pay the dept, is it better for me not to file my Tax Return ??? i am sure CIC shall not know about this Dept, no option C and i shall solve the problem with EI when i get back to Canada.

I hope Sharon or anyone to give me advise as to what to do, am i better off not to file my Tax Return ??
because i cannot pay this overpayment for employment insurance to human resources..... if i do file my Tax then this dept shall show up in option C printout, time is running out for me, april 30 is the deadline.

First thing, just file Option-C and see if the debt is there. If it´s there, deal with it, no point worrying about it. If the debt hasn´t shown up because HRSDC hasn´t referred it to CRA for Collection yet, then you are fine.

On your debt, if you have evidence to prove you are right and EI is wrong, contest it. Bring evidence that when you are receiving EI, you are in Canada and not in receipt when you are away. You can show bank statements, entry/exit records, etc. Bring it to your local Service Canada office and explain away.

If you do not wish to contest, you should make arrangement to pay back the debt, even if it´s $20 a month, whatever you can afford becauss if you continues to ignore, HRSDC can hand it to Canada Revenue Agency´s Collection Division, and CRA has the authority to go to your employer to withhold your pay check until the debt is paid off.

Thanks, i live and work outside Canada for 2 years so i can´t contest it from abroad.
Lets say HRSDC did hand in to CRA Collection division, how will that effect my spousal sponsorship with CIC ???

Hi, thanks alot for your reply and you are right, it´s not worth the risk and the stress i put me in. I can´t pay the amount in full, can i pay part of it to HRSDC for now, monthly payment ??? am i already late to pay part of the dept because April 30 is the deadline to file a tax return ???

call them, come clean and I am sure they will advise what is the best route to go. Yes, April 30 is tax deadline. Filed mine yesterday.

IF (cause I am not sure 100%) you are required to file, even if you don´t have the money... file anyway. Otherwise they start hitting you with penalties etc.

I received retro pay for work done the prev year-- the union contract was radified and I went on mat leave-- it took the buisness offfice 6 weeks to get the payment out, by this time i was on mat leave -- is it fair that I should have to payback money i earned before my mat leave
