Subject: Question to Sharon
  Sharon,

My PR Card is expiring in April 2011. Due to my personal circumstances, I was unable to come to Canada before.

However, now I decided to come to Canada permanently in September 2010. I am aware, that I have to stay there continuously for 2 years in order to renew my PR card.

Kindly respond to the following queries:

1) Will Immigration allow me to enter? Will there be any questions at the time of entry?

2) Can I work legally? Will employers there ask any questions regarding my PR card expiry?

3) Can I join the University if I want to study? Because I can renew my PR card only after 2 years of my continuous stay.

4) Is it easy to renew PR card, after completing 2 years of my stay in Canada.

Would appreciate if you could answer my queries.

you have a problem. In September 2010 you will have only 150 days in Canada in the 5 year period. You need 730. read the rules...right from the CIC website.

Maintaining Permanent Resident Status

Permanent residence status gives a non-Canadian the right to live in Canada. Permanent residents must comply with certain residency obligations to maintain their status.

Permanent residents comply with the residency obligation if, for at least 730 days in every five-year period:

they are physically present in Canada or,
they are outside Canada accompanying a Canadian citizen who is their spouse or common-law partner or, in the case of a child, their parent or,
they are outside Canada employed on a full-time basis by a Canadian business or in the public service of Canada or of a province or,
they are outside Canada accompanying a permanent resident who is their spouse or common-law partner or, in the case of a child, their parent, and who is employed on a full-time basis by a Canadian business or in the public service of Canada or of a province or,

they are in possession of a returning resident permit issued before 28 June 2002.

On arrival in Canada, permanent residents will have to demonstrate to the immigration officer at examination at the point-of-entry that

they have met the residency obligation in respect of the five-year period IMMEDIATELY BEFORE the examination or,
they will BE ABLE TO meet the residency obligation in respect to the five-year period FROM THE DATE AT WHICH THEY BECAME permanent residents.

Thanks for the detail clarificatioin Sharon. Yes, I work for GE-Money based in Middle East as "Investments Managers - Canada and USA". My job role is to get funds for various projects based in Canada.

I would like to point out that GE-Money is a global company, which also has operations based in Canada, Toronto.

1) What documents or proof should I bring while entering Canada related to my current employment?

the $64,000 question is whether GE-Money is considered a Canadian Company. In my mind, having a Canadian branch is a different issue.

Microsoft has branches in Canada but is not a Canadian company.

Thanks Sharon for your advise.

After landing into Canada, it may take some time to get job. In case if my PR card expires in April´11, am I still a legal permanent resident of Canada? Because, I can renew my PR only completing 2 years of my stay there.

Can I work or study in a University? (or) will they still insist on my valid PR card.

Kindly advise.

not sure I understand what you are asking. If it is deemed that you don´t have sufficent days in Canada to retain your PR, the rest of your questions are moot. They may not even let you into the country! You would be back to reapplying to work, study or immigrate.

Dear Sharon,

My driving license will be expired in Oct, 2010. But my permanent resident card is expiried already. Can I allow to renew my driving license and enter to Vancouver ?

And if I was selected by Quebec and by the time of renewing my PR I was working in somewhere like Toronto or Calgary...will i face a problem!!

Is it just me or do you also get the feeling that the number of stupid questions is significantly increasing lately?!
must be the weather....

@Asher: do the math: at the day your PR card will expire, how many days will you have spent within Canada? If it is less than the required 730 days, your PR status will expire as well - unless you come up with a very good reason such as your company is canadian based and sent you abroad. However, this should have been clarified beforehand. Again, you might have already lost your PR status as you will not be able to fulfill the requirements for renewal...

BM: Why dont you just renew your PR card if it is expired?
