Subject: Out of status in US wants to immigrate to Canada
  Hello there is my question.
I have been in US for the last 3 years and 4 months. 6 months with visa and the rest of the time out of status. I s it any possible way to immigrate to Canada legally? I mean any province /without going back in home country/ ?

I am citizen of European Union member country.
I am 28 years old , i do have 3 y of experience as bartender In US in high volume hotel.
I do have completed 3 years in University as design student to /I am willing to graduate /.
I do not have any felonies in US or Europe and I do not have deportation order.

You were admitted 6 months in the United States, that means you entered the US as a turist and decided that it would a better option to stay illegaly and see what happens.
Smart thinking boy.

You are NOT elegible to apply from the US. In order to do so, you have to be admitted into the US for a minimum of 1 year.

And based in the information you provided regarding your education, you don´t seem to qualify as a Federal Skill Worker.

You should consider going back to your home country, finish your degree, built up some experience in your field and follow the law and apply legally to come to Canada.

There is nothing "short" about taking short cuts. They cause more problems than benefits.

I came 2004 with J1 visa, I stayed 5 months in USA.
And second time 2006, I arrived with H2B visa for 6 months.

I do have more than 3y as bartender in 5 high volume hotel.
Doesn´t that help?

Ivan, you are staying illegally in the US. Let´s see what the FBI clearance says.... Anyway, just take a shot if you are curious. I´d bet they reject you.

Almost guaranteed you will be kicked back to the USA for proof of ties to your home country (which you obviously do not have).
Once you are returned to the US they will immediately place you under arrest and deport you back to your home country.
As you will not have a flight and may be sent to e ahearing first you will continue to be detained until your hearing and deportation.
After this has happened you will have HUGE issues entering Canada, as one of the thigns they look at is living illegally in any country.

I hope you voluntarily go home, please do not come to Canada.
We do not need people who are not law abiding, we have enough of those already.
Oh and your job is too low on the skill level, no matter if you hade 20 years of experience it is an uneducated job.
Your place of employment would need to first obtain a Labour Market Opinion for the specific job, and then you would be able to apply for a Visa and subsequently a work permit.
However there are numerous Canadians that can do your job, so thankfully you will be denied.

JP and Apron are way out in this one.

You don´t qualify to apply for PR from the US PERIOD. Forget the FBI and wages and blah blah that is just noise.

In order to apply under the FSW program you need to be admitted in the US for a minimum of ONE year.

I m not against your travelling to Canada but I will suggest you take the money you have worked all this time you have been living illegal tax free.this sound invading the tax payer in the state just pay your flight back home.Or else if you decide to come down to Canada after living in the u.s under this status there will be no chance for you either to get your legal situation fix.so go back to school you re wasting the begining of you adult hold for no good.

to whom it may concern,

i entered usa in 2003 as a tourist and got an H1B visa for 6 years. Unfortunately, my employer did not sign my labor certification (because of the economy and projects are slow)so i ended up going out of status with my family for the next 3 years.

I had the chance to submit my application to Canada (via a US based Canadian immigration lawyer) as a federal skilled worker. I´ve gone through the whole process (FBI, police clearance, and proof of finances) and had our medical exam. At the end, we were granted by the Canada Visa Embassy permanent resident visas.

Can I enter the US Canada Border by land even though we as out-of-status have our non-US passports stamped with Canadian permanent resident visas? We plan to land in BC, Canada driving a UHaul truck and a trailer carrying one car.
