Subject: Returning to Canada as PR after 3 years
  Hi,

I am really overwhelmed by ton of information here and am looking to your guidance.

I am a Canadian citizen and have been living in India for the past 3 years. My wife got her PR and we both went to Canada in April 2007 and stayed there for around 3 months. We have since then not returned to Canada and are planning to go to Canada sometime in July 2010/August 2010. I have my own company in India working in the video game industry.

1) Will I or my wife face any issues as we have not been in Canada for more than 3 years? Her PR Card expires in April 2012. I have read online that if a PR holder accompanies a spouse who is Canadian, the time spent with the spouse is considered in the total days of PR in Canada. Is this correct or are there some specific rules for this to hold true?

2) We have a kid who is 2.5 years who was born in India and he has a Canadian citizenship certificate. I am looking to apply for his passport from India but am confused regarding the guarantor section? Do I have to get a guarantor from Canada or will any guarantor from India do?

3) My Canadian passport expires in March, 2011. How long should I wait before I can renew it?

You have a valid Canadian passport and your wife has a Valid PR card, so I think you shouldn´t be facing any problem while traveling to Canada.

For the second part of your question 1, First of all where did you read this thing (if a PR holder accompanies a spouse who is Canadian, the time spent with the spouse is considered in the total days of PR in Canada.), can you provide the link to the forum? The information you have is wrong, I believe. The answer to this question is your wife has to be physically present in Canada to get her Canadian Citizenship. See the link mentioned below, calculate her application for Citizenship and you will come to know when can she be citizen.

If her citizenship process start date goes beyond the validity of her PR card and you decide to stay in Canada then you have to renew the PR card.

Otherwise she will loose her status and you might have to start from the scratch again.

It says, you have to search for the SPECIFIC GUARANTOR as mentioned in the Form, that Guarantor must be from India.

3) My Canadian passport expires in March, 2011. How long should I wait before I can renew it?

You can renew your passport before or after 1 year from the date of expiration date. So you can apply between March 2010 and March 2012 to renew your Canadian passport.
