Subject: This could be complex ...
  I am a joint UK/Canadian citizen, living in London UK. I became a Canadian in 2000, as a result of a long term relationship with a Canadian (1994-2000) and lived in Canada from 1995 - 2003. I returned to the UK for a job in late 2003 and have been here since. I´ve long wanted to return to Canada.

My partner is South African. He came to the UK on a 2 year visa in 2006, and entered a Civil Partnership in 2007. That relationship broke down in late 2007, shortly before we met. However, they have not yet been able to dissolve the partnership. We applied for him to stay in the UK on the basis of OUR relationship, however, this was rejected in late 2008 as he was in a Civil Partnership with his ex. We have since been in the UK together, although he does not have a legal status. We´ve not hidden the fact he´s here, and have been trying to deal with the situation openly.

We´d both like to move to Canada, and I´d like to sponsor him as Common-Law. I know that our relationship qualifies, and I just want to make sure of the route to follow;

Should we apply to the London High Commission as UK residents? We really don´t want to go to South Africa to do this!

Are there any other thoughts / advice that people have?

he will need clearances from the 2007 relationship.
