Subject: Can I apply twice for Canadian Immigration?
  Hi,
I applied for the skilled worker immigration before February 27, 2008 and its taking almost 5 to 6 years. Can I apply now again ( a new application) as the current processing time is about a year?

Is there any restriction that I can not apply twice?

Hi Arakha,

Everything happens for a reason, In my opinion you should not be sending another application, due to few reasons,

1)
your application is already in and you might have the file no with you, means they have you in the system, if you change your mind and send the new papers in (IF THE CATEGORY FITS YOUR PROFESSION THEN ONLY)it might be interpreted as a fraud and you will face the problems might never get a visa for Canada.

2)
you already have paid the fees you need to pay it again so basically waste of money. If you have that much money put them in stocks or bonds on in fix deposits with banks for your better future.

I disagree with Nisha on certain points.

All applications pre -February 2008 will be looked at ´first in - first out´ AFTER the post 2008 applications have been exhausted and there is still no guarantee you will be accepted.

If you qualify under the new NOC codes, you will have a yes or no answer within a year. What is that worth to you? $550 is a lot of money but so is putting your life on hold.

I don´t consider that a waste of money. at 3% interest (the stocks and bonds idea) is about $16 a year or 1 hour of Canadian wages.

I would not be surprised if you were sent a letter in 2008 asking if you wanted to withdraw your application and reapply. Did that happen?

What embassy are you applying through?

Nisha is not giving you the right advise here, actually it doesn´t make any sense.

I personally think you should withdraw your application and if you qualify, re-apply. It is going to be faster, since you will be assessed under the new criteria.

Sharon and DocD are correct. If you meet under pre or post 2008 requirements, you should consider withdrawing the old and re-apply. If you meet under pre-2008 but not under the post-2008, then stay with the old.

I had applied in 2005, but didn´t receive any letter, can i apply again in fast track without withdrawing the old case.

Applicants who had applied for immigration under Federal Skilled Workers Class at New Delhi in June 2003 and onwards i.e. Pre-Feb 2008 are forced to wait for more than 7 years, without any fixed time-line for a decision on their cases.

Such long processing times dissuade legal immigration and creates a congenial atmosphere for crooked immigration Consultants and Agents to lure would-be immigrants by promising them faster immigration, based on forged and fraudulent documents.
Addressing this issue of backlog, would be a step towards taking anti-fraud initiatives against these scamsters and unlawful Agents.

Kenneys visit to India would be useful only if it redresses problems faced by applicants who want to migrate to Canada legally.

China´s processing time is half of India´s because there are half the number of applicants in line. India has the largest quota in the entire immigration system.

New rules gave 2003 applicants the option to withdraw and apply again. If they don´t have the right skill sets, they are best to wait their turn - otherwise they don´t qualify at all.

If there would be less fake documents, each application would take far less time to process.

CIC has taken the steps to offer 1 year answers for application in a very narrow range of skills. That is the best they are going to do. If the old applicants qualify under the new rules I would recommend withdrawing and applying under the new system.

Like everyone here,My processing started in Feb10,2008.The processing time says 93 months .and my application shows " In process"
My question here is ,should i wait for my processing time to get over or can i re-aply under the new system ..Will this make any difference to my old file..I dont mind paying the application fees once more.I ma just not sure if whether i should wait this out for the CIC to come back to me saying that the file has not gone through or should I re-apply

first question - do you qualify under the new rules with the current list of accepted skills?

if so, and only then, consider withdrawing your application and filing under the new rules. You cannot have 2 applications in the system at the same time.
