Subject: Inland sponsership facing deporation
  I´m currently inadmissible. my student visa expired on July 3 2008 and i received a letter from the immigration to leave voluntarily in November 2008 and then a deportation order in Feb 2009. I got married in may applied for overseas spousal sponsorship was called for an interview in April 2010 which i did not attend because i did not want to leave the country in case they refuse my application and we were misguided by our lawyers.After a moth we recived a letter from overseas stating that our sponsership has been refused due to failure to attend the interview as a result the ARC got refused too. so we met up with another lawyer and they advised us to apply inland application, which im hearing is a long process and the CBSE can come anytime and deport the person who´s inadmissible. What is the best thing i should do at this point of time.i do not have any criminal record and my medical is completely fine and i have a valid passport and my husband has a good record and has a good job to support me. Please advise

Your both in Canada and the failure is your counsels fault LOL.

In July 2008 your student visa expired and you stayed anyways. You were told to leave immediately or enforcement action may follow. Like you did not know it was wrong to defy Immigration and you did not known that was wrong.

Instead of submitting inside Canada after marriage you submitted overseas spousal and failed to attend your interview and that was Legal Counsels fault, LOL, LOL, LOL!

Another Lawyer informs you that you can apply from within Canada and you think CBSA can pick you up anytime. Like you´re really important.

Why do you not focus on the fact that your overseas spousal application was prepared so poorly that it got kicked for an interview. Then you refuse to attend the interview to prove your marriage.

Why would you apply for an ARC since you had never left????
You had nothing to prove that you had ever departed Canada unless you lied on your schedule one list of addresses!

Your actions I think do not really warrant an ARC.

My advice read the manuals regarding InLand Spousal Public Policy.

I would be nervous about an inland sponsorship - no option for appeal. Leave the country and apply outland.

given the string of stupid moves (sorry... there is no polite word for it) you need all the help you can get - including the option to appeal.

- Deportation letter on Nov. 2008 to leave before Feb 2009
- Married in May, applied overseas sponsorship
- Sponsor interview in May, 2010, but did not attend
- June, 2010 oversea Consulate advise Sponsorship was refused

Why don´t you file in Inland sponsorship first since you and your husband both live in Canada?? instead Overseas?

I have my family sponsorship appeal done by a Consultant in Vancouver last year. I understand that lawyers, Consultants are not working in specific area and they just fool you around. Need lawyer or consultant to work on Specficly on Family Sponsor and Family sponsor Appeal. Then he can tell you the best solution at this stage.

Are u pregnant right now? Any kids? This will help you to stay too!

No no no, it will NOT! Being pregnant will not prevent her deportation not even having kids even if they were born in Canada....bad advise.


In-land sponsorship is probably the worse route to take at this point in time.

You failed to depart Canada when you were given the blue form called "Volunteer departure order" and 30 days later becomes a deportation order.

It can happen. Once she applies for an inland, CBSA may or may not pick her up and send her home. There is a deportation order against her and that will pop up under her customer number once CIC assigns a file number to her case and as you are well aware, having an inland application in process will prevent your deportation.

Based in the previous information in file (previous application) her chances of being approved inland are very slim to none.

You should withdraw your inland application, leave Canada, apply from abroad for an ARC and submitt your out land application.

There are a lot of changes coming up in terms of removing people from Canada.

My mistake, I mean in the last sentence that having an in land application in process will NOT prevent your deportation.

Im worried if i leave Canada, i might never be able to come back. Well thats what ive been told. and i dont wanna leave my husband because i love him dearly and we cant imagine a life without each other. So if i apply overseas, and it gets rejected, what is my other option. am i gonna be stuck in my country without my husband for years ? and why is inland application always considered negative. Will they reject me on grounds of inadmissibility ?im aware of the fact that cbsa can deport me anytime even if i have a pending application in process, is there anyway to waive the deportation ? if i get approved in the first stage which about after 6 months is that a good sign ?

you are ignoring one critical fact - there is nothing stopping your husband from going to your home country to live with you. Together does not have to be in Canada. or oooops... is love dependent on geography?

Public policy allows for a PRRA. If an InLand Spousal is submitted before being called to a PRRA causes removal to be deferred until the InLand Spousal is assessed based on that Public Policy.

Her other Lawyer is correct she can file an InLand application.

Chances of success, ZERO!

Chances of an ARC since she never even attended her marriage interview, VERY LOW.
