Outside spousal application

Subject: Outside spousal application
  Hello everyone,

Okay, so from previous posts I understand "outland" spousal support applications are best.

I have a USA client who married her Canadian fiance (in the States) and moved up here to be with him on a visitor visa. I have a few questions:

1. if she goes back to the USA, is there any reason she will not be allowed back into Canada if she has a valid visitor visa?

2. Will there be any problems with her applying for a work permit while her PR application is pending?

3. She has two children from a previous marriage. Can they enroll the children into the school in Canada in September? I´m assuming they will have to change to student visas...

4. Does she actually have to be in the States for any amount of time and if so, how long?

I´m a law student. Our firm mostly deals with family law, but because we´re a rural practice, we sometimes get to do work that´s not related to our primary business. Your response was very enlightening, Roy, but not particularly useful.

I find it rather interesting that you believe that lawyers would by default know all the intricacies of immigration policy, since very few actually seem to do that kind of work.

My questions were in respect of practical considerations. I know the text-book answers, but I also know that that type of knowledge has little to do with how things work in reality: Hence my questions. Since I don´t have practical experience, it makes sense for me to ask someone who does, don´t you think?

Anton, if you don´t know the basic rules of immigration, you should not even pretend that you do to your client. Asking at a discussion forum - shocking. Are you going to tell your clients they could ask a stranger on a website for free?

at least go to www.cic.gc.ca and read the manuals.
