HI ROY I HAVE A QUICK QUESTION AND I NEED AN ANSWER MAYBE YOU CAN HELP?

MY EX WAS HERE IN A VISITOR VISA AND HE OVERSTAY, HE IS BEEN IN THIS COUNTRY FOR ALMOST 8 YEARS ILLIGAL, HE GOT CAUGHT A WEEK AGO AND IS NOW IN A DETENTION CENTRE, HIS BOSS WANTS TO BAIL HIM OUT, BUT HE HAS NOT BEEN ABLE TO GET A LAWYER ALMOST EVRYONE HAS TAKEN THE LONG WEEKEND OFF,SO THEY WERE THINKING OF GETTING HIM OUT, CLAIM REFUGEE , HE HAS BEEN WITH HIS FIANCE FOR ALMOST 2 YEARS HE WAS GOING TO GET MARRY THIS SUMMER BUT THIS CAME FIRST HE DOESNT WANT TO GO BACK TO HIS COUNTRY FOR PERSONAL REASON, SO THEY WERE THINKING OF GETTING MARRY AND APPLY IN-LAND, WE HAVE A DAUGHTER TOGETHER AND HE REALLY DOESNT WANT TO GET SEPARATED FROM HER, THATS THE REASON HE WANTS TO DO IN-LAND, WOULD YOU BE WILLING TO ACCEPT THEM AS CLIENTS OR HE HAS ZERO CHANCES OF GETTING OUT?

If he has been in Canada for nine years since his visitor visa expired, he may be released on bond posted by a PR or a Canadian Citizen. ( he must have no criminal record, an immigration warrant, or never been removed before.)

At this point, one can do without a legal counsel.

Then, after being released with terms and conditions, he will have to report to GTEC.

Within 3 to 4 weeks, he will attend an interview where he will receive an exclusion order which is his chance whether he would like to make a refugee claim.

Yes, it will be a choice of lifetime.

You got time to post this here but you never called, WHY?

Why all in CAPITALS?

This individual has been with his Fiancee´ for almost two years by that can I assume Common Law? That would be his best option and you do not have to wait until he gets out.

If he gets out!

Now Anonymous is basically correct but what led them to believe he is detained in the Greater Toronto Area? Why would they read into your post that he would have to report to the GTEC Greater Toronto Enforcement Centre at 6900 Airport Road?

Why on earth 233.201.58 would you tell anyone that he would be released on Terms and Conditions???? He will need a bonds person after being in Canada for NINE YEARS ILLEGALLY!

Expect the bond to be several thousand probably $4,000.00 CASH along with a Surety Bond (promise to pay) in the amount of $5,000.00 Then have evidence of worth in excess of $30,000.00 because CBSA will want to see six times the worth of the Surety amount.

NEVER MAKE A REFUGEE CLAIM AFTER BEING IN CANADA FOR NINE YEARS!!!!!!!!!!!!!!!

When he gets his exclusion order his removal will be deferred due to public spousal policy. They will look at everything including the timeing of any application.

Would I take him as a client if he made a Refugee claim, NO! Spousal, probably but that probably is based on the very limited information you provided.

Authorized Representatives who do detention, who are knowledgeable about the Immigration Division procedures always work weekends and answer their phones. People who have friends in trouble or persons detained want to speak directly to Counsel not some employee who claims he/she is in a meeting.

I had a refugee claimed denied. Soon after I filed for the H and C application. Two months after I received a letter from Gtec asking that I report to airport road for an interview. I am to bring all identity documents. The letter also stated conditions for reporting and that I will be required to report to them everymonth. What can I expect at the interview? Will they have a removal notice waiting...or it my come after...Thanks for your help
